Under the OIA, could I please request the following information:
1) How is a complaint assessed when first received by the Commission?
2) What factors determine whether a complaint is progressed to an inquiry/investigation?
3) What staff (job titles only) handle a complaint at the various stages of the process?
4) Is there a triage process for complaints (i.e. a committee or panel)
5) If yes, please provide a terms of reference
6) If yes, please provide all decisions or determinations made by this committee including all supporting documentation between 1 January 2023 and today (Friday 30 June) (these can be anonymised to protect complainants details.)
If there is no triage committee or panel, questions 5 and 6 can be ignored.

Dear Samurai Green
Thank you for your request. Please provide evidence of your eligibility
under section 12 of the OIA to make this request. The eligibility
requirements are:
o a New Zealand citizen; or
o a permanent resident of New Zealand; or
o a person who is in New Zealand; or
o a body corporate which is incorporated in New Zealand; or
o a body corporate which is incorporated outside New Zealand but which
has a place of business in New Zealand

We have started to collate your request and note that completing point 6
of your request could result in a refusal of the request under section
18(f) of the OIA – substantial collation.
You have asked for “…all decisions or determinations made by any screening
committee including all supporting documentation between 1 January 2023
and today (Friday 30 June) (these can be anonymised to protect
complainants’ details.)”
The teams reviewing the complaints received by the Commission meet three
times a week to discuss different matters and each time there is a meeting
an agenda is produced, and decisions are made. These are the documents
that would fall within the scope of point 6 of your request. However,
given the detail contained within each document, and the number of
meetings, it would take a substantial amount of collation (and checking
through each document to ensure anonymity of each party) to provide the
information to you for the period requested.
We suggest reducing the timeframe of your request to the last month before
the date of your request. This would involve around 12 meetings, which
would give you visibility of our complaint screening process.
We have also considered charging for the collation of the information
and/or extending the timeframe to respond to your request. However, we do
not consider it appropriate to charge in this instance, and extending the
timeframe significantly could be an option if you require 6 months of
meeting documentation. However, in the first instance we suggest reducing
the scope of the request and as discussed above, providing you with one
month of meeting information to give you visibility of our complaint
screening process.
Please let us know whether you agree with this approach, and we will
continue collating the information responsive to point 6.
