46 lots at Teitei Drive, explanation for remaining 2 residential lots

Barry Murphy made this Official Information request to Kāinga Ora–Homes and Communities

The request was refused by Kāinga Ora–Homes and Communities.

From: Barry Murphy

Dear Kāinga Ora–Homes and Communities,

As per the document shared on Kāinga Ora website https://kaingaora.govt.nz/assets/Publica... , Page 2 shows 46 residential lots, of which 44 have been advertised to the public as a 15/15/14 split between social, affordable and workers accommodation.

1./ Please advise what the remaining 2 residential lots are being used for
2./ Who will own the remaining 2 titles, or who will they be transferred to
3./ Please provide any documentation relating to the remaining 2 residential lots, such as agreements, contract for them, discussions around who will get them or who they would/could be allocated to. For the avoidance of doubt, this is any emails, txts, discussions, social media messages, phone calls, etc.

Yours faithfully,

Barry Murphy

Kia ora Barry

Thank you for your request below, dated 29 September 2023, for information

(OIA).

We will respond to your request as soon as possible and in any event no

request was received by Kāinga Ora in accordance with section 15(1) of the
OIA.

We will respond to this request and your other related requests, received
28 and 29 September 2023 as a single request.

If we are unable to respond to your request by 27 October 2023, we will
notify you of an extension of that timeframe.

We may also contact you if further clarification or refinement of your
request is required to enable a decision to be made.

Ngā mihi

Dear Kainga Ora Correspondence,

I received an email response to my person email (not this FYI), which has the reference OI 23 553 and referred to these questions.

The following questions are still unanswered:
1./ Please advise what the remaining 2 residential lots are being used for
2./ Who will own the remaining 2 titles, or who will they be transferred to

The following question I was referred to your website which has released emails and documents, however none of the documents, emails or communications refer to the additional 2 lots, so I consider this OIA a fob off and unanswered; as the documents you refer to do not contain the information asked for:

3./ Please provide any documentation relating to the remaining 2 residential lots, such as agreements, contract for them, discussions around who will get them or who they would/could be allocated to. For the avoidance of doubt, this is any emails, txts, discussions, social media messages, phone calls, etc.

Yours sincerely,

Barry Murphy

Dear Mr Murphy

This request was acknowledged in our letter to you of 19 October 2023
(sent to your personal email), which acknowledged this request and several
others.  We advised you that we are treating these additional requests as
one request, and notified you of an extension of time to make our
decision, to 28 March 2024. If we can respond sooner, we will do so.

We advised you that in accordance with section 15A(1)(a) of the Act, this
extension is necessary because your request necessitates a search through
a large quantity of information and meeting the original time limit would
unreasonably interfere with our operations. You have the right to seek an
investigation and review by the Ombudsman of this decision. Information
about how to make a complaint is available at
[1]www.ombudsman.parliament.nz or freephone 0800 802 602.

Regards

Monique

Dear Kainga Ora Correspondence,

As I have previously stated, I do not accept the response or the aggregation of OIA's.
I do not accept the extension to 28th March 2024 either, as the resource consent will likely have an outcome by then.

RDC was asked the exact same set of questions and responded saying "RDC would have transferred this request to Kainga Ora as it is believed to be more closely connected with the functions of the agency that submitted the resource consent" RDC are now stating information that contradicts statements made by KO, where the consent is a partnership and all designs and decisions are made by the partners. It also makes the claim that Giles Tait had more authority and decision making than KO have claimed to date as RDC are not fully in the know of the decisions or documents pertaining to the remaining land.

Thus, my questions remain and I expect an answer immediately.

Yours sincerely,

Barry Murphy

Dear Kainga Ora Correspondence,

I still do not accept this extension. You have failed to answer this questions asked multiple times In Multiple ways.

You should be able to answer question 1 and 2 very easily

Yours sincerely,

Dear Kainga Ora Correspondence,

I remind you that the following 2 questions were not responded to by 27th October but rather ignored in your response:

1./ Please advise what the remaining 2 residential lots are being used for
2./ Who will own the remaining 2 titles, or who will they be transferred to

When I followed this up, you treated the questions as new questions, which is unacceptable as it was Kainga Ora that failed to response, or chose to ignore the question to buy further time.

Yours sincerely,

Barry Murphy
