Good afternoon Stephen,

Thank you for your email.

Under section 18B of the Official Information Act 1982 (the Act) Ministry of Business, Innovation, and Employment (MBIE) has the "Duty to consider consulting person if request likely to be refused under section 18(e) or (f)." In these instances, due to the large volume, we identified that your requests, as received, would have been refused under section 18f as "the information requested cannot be made available without substantial collation or research." Our duty was to consult and assist you to narrow the approach of your requests as we considered that it may help the reason for the refusal.

In this case, we extended your request under section 15A(1)(a), which allows us to extend the time if the request necessitates a search through a large quantity of information and meeting the original time limit would unreasonably interfere with the operations of the department. This is not to cause an undue delay in the release of the information, but rather an extension to allow us to make a decision on your request.

In the case of this specific request, we can advise that our initial results exceed 600 emails. This does not account for attachments included in the emails. Conducting the search and retrieving these results does take some time.

Reviewing this material, assessing what is relevant to the specific request, then formatting the in scope information all takes time. Once the material has been collated, we then commence an assessment of the material to identify if there is any information that needs to be withheld. Consultations with subject matter experts and relevant third parties (including private groups as well as other government agencies) assist us with this assessment.

By comparison, requests for specific documents can often be completed sooner as we can locate these quickly without needing to engage in specialist records searches.

In all cases, especially where there is a large volume of correspondence requested, collating this information takes time. MBIE takes its obligations under the Act very seriously. We strongly believe in the importance of transparency through the release of information and work to provide timely and accurate responses to information requests.
