I refer to your OIA request of 16 January 2024, in which you ask for:
‘This request is for information from 1 May 2023 by the Regulatory
services unit covering the advice provided to Penny Nelson or DOC SLT, the
Minister, or MBIE regarding the issuing of concessions to PTL /WHL for
Turoa and Whakapapa ski fields.’
The purpose of this email is to clarify and refine your request under
section 15(1AA) and 18B of the OIA. This is because your request, as
currently framed would likely involve substantial collation and research
to the extent that we are considering refusing your request under section
18(f) of the OIA.
In this case, the Department has had significant engagement internally and
with other agencies about RAL, all of which references or relates in some
way to the concession process – as the Department leads this process. As
such, we are seeking your agreement to limit your request to be for:
1. Formal advice to the Minister of Conservation primarily
related to the concession process for Mt Ruapehu, since 1 May 2023.
2. Formal advice to the Director-General of Conservation
primarily related to the concession process for Mt Ruapehu, since 1 May
2023.
Refining your request in this way will capture the Department’s key
updates on the concession process for Mt Ruapehu, while mitigating the
significant volume of documents otherwise captured by your original
request.
Please respond by 31 January 2024 to confirm that your request can be
refined as above. If you have any questions, you can respond by reply
email.
