Under the provisions of the Official Information Act I request copies of the 14 Feb 2024 Port Hills fire Incident Actions Plans (IAPs) for the first 6 days (ie 14 Feb - 19 Feb). These plans to include those for the Day and the Night shifts over that period.

Dear Official Information Requests Team.
Thank you for the very large PDF of Port Hills (2024) IAPs. I can not make sense of the plans having noted the following:
1. There is an 18 page IAP prepared within the Initial Response period (3.5 hours) for the 1st night (14th). Whilst it is incomplete and contains a number of errors it is unlikely that the IMT could have prepared this document within this time.
2. There is no IAP for the Day Shift on the 2nd day (15th)?
3. The date for the IAP headed Sat 18th is wrong. Saturday was the 17th?
4. Ditto the date for the Sunday IAP should be 18th, not the 19th. This is also Day 6 not Day 4.
5. There is an IAP stating it covers two days (the 17th and the 18th). This conflicts with the dates above?
6. There is no IAP for Day 5 (Sat 15th) or night 5 (15th and 16th. This may however be because of the errors above in the days and the dates.
7. All of the IAPs are very incomplete and are missing significant information.
8. None of the IAPs are signed off by the IC and dated/timed accordingly.
There are so many errors and omissions it may be possible that you have sent me the wrong file and this is some earlier draft versions of IAP documents prior to their completion, QA and sign off.
Can you advise/confirm that I have the correct versions of the Port Hills 2024 IAPs.

We write regarding our previous response of 12 June to your OIA request
for copies of the Worsley Fire IAP’s.
Thank you for your email of 14 June. You are correct in your assessment
that the documents included drafts and incomplete versions of the IAP’s.
Further to this we are advised the IAP’s are being used to inform the
post-incident analysis and investigation.
Therefore, the IAP’s were provided to you in error and your request should
have been refused pursuant to section 6(c) of the OIA, as the making
available of that information would be likely to prejudice the maintenance
of the law, including the prevention, investigation, and detection of
offences, and the right to a fair trial.
We have written to the FYI website and ask that they remove the documents
from the public website. We would also ask you to delete and to not share
the document we provided on 12 June, please.
We appreciate your understanding on this matter and apologise for any
inconvenience this may cause to you.
Once the risk to the maintenance of the law is no longer applicable, our
commitment is to contact you to advise that you can resubmit your request,
which we also commit to process with with urgency.

Dear Official Information Requests,
Your advice regarding the incorrect information sent to me in response to my request for the Port Hills Incident Actions Plans is noted. I do not however agree that providing me (as requested under the provisions of the Official Information Act) the correct versions has some implications in regards to "the maintenance of the law" and is therefore refused. I assume in this regard you refer to the Operational Review of the Port Hills fire and/or the investigation into the burnover of firefighters. However, the IAPs are a record of the plan prepared for the response and themselves are not in question or dispute. I intend to take this question up with the Office of the Ombudsman on this basis.
That you provided me with information that was obviously incorrect and incomplete and raises a further concern as to how/why this happened. It is difficult to avoid the conclusion that this was done because there were no IAPs completed for the Port Hills fire and signed/approved by the Incident Controller. It is also difficult to not come to the conclusion that this fact was being deliberately covered up with the issue to me of the very dubious documents in response to my request. This may be a further matter for the Ombudsman to consider.
I think it is fair to say that FENZ's crediblity on this matter is seriously in question.
