Dear New Zealand Police,

If someone has written to the NZ Police and the NZ Police have determined that the correspondence is "partially covered" by the Official Information Act 1982, must the Police:
* Confirm which questions are covered and not covered by the Official Information Act 1982?
* Meet the 20 working days deadline for all questions which are covered by the Official Information Act 1982?
* Provide a deadline for all other questions which are not covered by the Official Information Act 1982?
* Can the police ignore questions without giving any reason(s)? If so, please provide a list of all valid reasons.

For each of the above questions, for the answers please refer to the appropriate legislation by Section of the Act (or similar)

What are the consequences for the NZ Police failing to meet the 20 day deadline for information requested under the Official Information Act 1982?

What is a reasonable deadline for all other questions which are not covered by the Official Information Act 1982?

Please provide a copy of any documentation, including processes and procedures, that the NZ Police use to determine if a question is covered by the Official Information Act 1982 or not. This should include the time frame for this to happen.

Please provide a copy of any documentation, including processes and procedures, that the NZ Police use to determine if a request should be classed as "urgent", as per Section 12(3) the Official Information Act 1982 or not.

As per Section 12 of the Official Information Act 1982 I can confirm that I am entitled to make requests under this Act as I satisfy criteria as listed in Section 12(1) as being someone who may make requests under the Act, which includes residing in New Zealand.

All information should be shared via the FYI.org.nz website (as per the guidance on https://fyi.org.nz/body/new_zealand_police).

Please find a review of the OIA response below.

Q1

This response does not make sense. If there are questions which are “partially covered” by the OIA, then those which are must be answered in line with the requirements of the OIA. This will identify which questions are covered. Logically, any which are not covered in the response are not covered by the OIA. This of course assumes that the police have correctly answered all questions covered by the OIA.

Q2

The answer does not address the question. The question was relating to the consequences and not the process.

Q5

The answer directs me to the following web page (https://www.publicservice.govt.nz/guidan...) and refuses to answer as the information is already publicly available.
However, a brief glance at the data shows the latest information is covering the time period between July and December 2022. The current date, as I write this, is the 24th June 2024, with almost 1.5 years of missing data.

This means that the information as requested is not publicly available, at least from the source identified in the OIA response.
