Dear Kaipara District Council,

I am seeking clarification on a specific aspect of
The Local Authorities Act(Members Interests)

Section 3-6
My questions are as follows and relate to the following dates
From the dates of the swearing in of our newly elected councillors in 2022
to March 31st 2024 and again to and including June 10th 2024

1. Could you please provide information regarding any
a. financial relationships between the Kaipara District Council and KDC
elected members, committee members, their related entities and the CE,
b. details of any outstanding debt to Kaipara District Council that KDC
elected members, committee members, their related entities and the CE have
incurred up to and including The dates above
2. Please outline the number of times and upon each occasion elected
councillors committee members and the CE have recused themselves from a
vote due to the potential or declared conflict of Interest.
3. Please provide a list of gifts, donations (gratuities) that each have
declared during the dates in questions.

+ KDC is responsible for Elected Member Remuneration. For more
information on the amount members receive see the [8]LG Members
Determination. This is for FY23/24 however the new FY Determination
began 1 July 2024. It should be available online soon.
+ Elected Members can claim expenses. The claims must align with the
[9]LG Members Determination and [10]Elected Member Allowances and
Recovery of Expenses Policy
+ Non-elected members who are appointed to committees can also claim,
again the claims must align with the [11]Non-Elected Member
Remuneration Policy
+ Elected Members are to make a declaration of Interests at least
annually, refer [12]Register of Elected Members Interests
+ No financial relations between KDC and CE

b. details of any outstanding debt to Kaipara District Council that KDC
elected members, committee members, their related entities and the CE have
incurred up to and including The dates above

+ There isnt an opportunity for elected members and committee members to
create debt. They incur expenses and have to claim back as per above
policies.
+ Related entities – Council does not hold these details.  The Elected
members can be contacted directly.
+ CE has no debt to KDC

2. Please outline the number of times and upon each occasion elected
councillors committee members and the CE have recused themselves from a
vote due to the potential or declared conflict of Interest.

+ These are declared in all minutes for all meetings. It is up to
members to declare any conflicts. To access minutes please visit the
KDC website [13]Meetings, Agendas and Minutes Instructions on how to
find minutes are listed on the web page.

3. Please provide a list of gifts, donations (gratuities) that each have
declared during the dates in questions.

+ Please refer to the [14]Gifts for Elected Members Policy.  A list of
gifts and donations is attached.
