Dear Ministerial Services Inbox [TSY],

I find it very difficult to understand why the delay in responding, or who this consultation is with, why it necessary and why there is a delay.

This is a very simple request for copies of 3 specific documents. There is no need to review correspondence and decide what is relevant to the request.

You will be aware of recent guidance by the Ombudsman about delaying responses by claiming on-going consultation?

Can't immediately find the Ombudsman's comment but copied down this from a report on a 'consultation' delay - likely to be a decision on a request to Health New Zealand - might have been reported in a Newsroom article

The Ombudsman’s analysis, provided in an appendix to the letter, said a government agency is expected to know what information it holds, and it should, generally, be able to meet the statutory timeframes of an OIA request.
If section 15A(1)(b) is used as an exception, “an agency has to clearly demonstrate each element is met before an extension to undertake consultation is justified”. Those elements are that consultations are “necessary” such that a proper response can’t “reasonably” be made within the original time limit.
While it’s not stated explicitly in the law, Boshier said consultations “should entail discussions that are additional to, and separate from, the actual decision on the request”.
“The discussions need to be of such a nature that they encompass information that a decision-maker in an agency with good systems in place cannot reasonably be expected to know without the consultation taking place (which makes the consultation necessary).
“In other words, the consultation must aim to seek information that is specialised in some way.”

The Ombudsman’s analysis said ordinarily an agency should be able to identify at an early stage what internal and external consultations are necessary and build that into their response plan.
“HNZ has not explained why the information within scope of the request was not followed up more promptly within the original 20 working day timeframe.”

Thanks you the information provided in response to my request "Please provide copies of the Quarterly Investment Reports for June 2023, September 2023 and December 2023, being the reports missing from your web page on quarterly investment reporting".

You have provided a copy of the Quarterly Investment Report for June 2023.

However you say nothing about the Quarterly Investment Reports for September 2023 or December 2023 (although the December report may be buried in Annex B of Treasury Report T2024/243: Ministerial Engagement on investment management). Please confirm that these exist and explain why copies of these have not been provided.

I note that none of these three Quarterly Investment Reports are on the Treasury web page on quarterly investment reporting, although reports dated before and after these three are.
