Dear Ruapehu District Council,
On 4 September 2024, the Chief Executive was directed to provide further information on the potential implications of the Council refusing to comply with the Local Government (Electoral Legislation and Māori Wards and Māori Constituencies) Amendment Act 2024.
We expect that any advice relating to a decision by any Council to act contrary to law will be promptly made available to the public. With that in mind:
1. Please release any advice provided to or prepared by the Chief Executive on the consequences of not complying with the above mentioned Act, if already in existence.
2. If such advice does not yet exist, please advise of the expected date it will be.

Dear Info,
I remind you that you are obliged to release official information in all circumstances, except where the LGOIMA requires information to be withheld. This includes where privileged information is created by a third party (such as Taituarā) and provided to a local authority, where it becomes official information liable to be released under the Act.
1. Please provide the grounds in support of refusing to release the advice.
2. Please explain why the public interest in local councils acting lawfully is outweighed by the need to protect legal professional privilege.
3. Please also explain, if the public interest does not prevail in fully releasing the advice, why there was sufficient public interest to waive legal professional privilege over some, but not all, of the advice in your response email when you explained who your lawyers are and when the advice was provided to Council.

Dear Ruapehu District Council,
On 11 September 2024, I requested official information from the Council relating to its recent instruction to the Chief Executive to obtain legal advice on not complying with the Local Government (Electoral Legislation and Māori Wards and Māori Constituencies) Amendment Act 2024 (the Maori wards legislation).
You responded on 4 October 2024 denying the request. On the same day, I replied seeking further information relating to that refusal.
I appreciate that it has only been a few days since, however, can you please confirm receipt of my last email? I appreciate that fyi.org.nz can sometimes cause emails to get lost.
An estimated response timeframe would be fantastic also, if its possible.
