I now formally request access to the aforementioned non-finalised/draft reports which per the ombudsman have the same standing under the OIA as "finalised" documents - i.e. they are still official information - regardless of the fact that they are in draft.

I want access to these documents that are noted in your previous reply

"The four ‘Steps the Electoral Commission has taken in response’ referenced in OIA 2023/84 have been taken in the form of two reports. These reports are in their final stages but have not yet been finalised. We are therefore refusing your request under section 18(e) of the Act on the grounds that this information does not yet exist. Dear Karl,
It seems that these have been in draft for a long, long time, these were referenced in OIAs from more than a year ago, since the election . When do you expect these to be available and whenever that is can you send them by adding them in a reply to this OIA on fyi.org.nz?

These are not the only documents that have eluded the public. The content in draft or otherwise is neither here nor there, it are just another example of a continued resistance to responding appropriately to OIA requests, in my opinion.
How much other official information is being withheld due to the spurious 'draft status' rationale. Can you answer that.

There has also being attempts to say that documents were "internal". I have never heard of such a thing, it seems to be code for "we said they exist but the actually don't".

It has typically taken the electoral commission an exorbitant amount of time to provide proper responses to offical information act requests, often requiring further clarifications and more specific questions and generally being obstructive.

I will be making a complaint if there isn't a satisfactory response from you at a minimum I want an indication of when these will be available and a commitment to providing them by responding to this OIA request.

We wanted to respond to your emails regarding the reports you've been
inquiring about.

 

As previously mentioned, the Commission remains committed to making the
reports available to you as soon as reasonably practicable, Chief
Electoral Officer Karl Le Quesne’s letter to you dated 5 December 2024
stated that we anticipate release will take a few more weeks, weeks which
included the shutdown period over the Christmas break. Currently, we are
awaiting approval from our Board before we can proceed with release. The
next Board meeting is scheduled for February, and once we have their
agreement, we’ll be able to move forward and provide you with the reports
as promised.

 

We understand the anticipation, and we appreciate your patience in this
matter. We’ll make sure to keep you updated as soon as we have further
information.

Dear OIA Enquiries & Karl

Here is what I think is happening...
I don't believe you
The documents don't exist.

You are lying under this and other OIA responses about the steps you have taken to address the mistakes of 2023.

I predict that you will come back with an excuse that said documents were not approved or submitted to the board in February in an effort to buy more time. In all my OIAs you constantly dodge questions or provide frivolous answers for example when questioned on the governance/management documents for the election period where documents also did not exist.

Lying to the public especially through the OIA channel is reprehensible, I will ensure that this gets press coverage if it is the last thing I do. The only way that you will avoid this is by releasing these documents- which you can't because they are fictitious

We wanted to respond to your emails regarding the reports you've been 
inquiring about.

 

 

 

As previously mentioned, the Commission remains committed to making the 
reports available to you as soon as reasonably practicable, Chief 
Electoral Officer Karl Le Quesne’s letter to you dated 5 December 2024 
stated that we anticipate release will take a few more weeks, weeks which 
included the shutdown period over the Christmas break. Currently, we are 
awaiting approval from our Board before we can proceed with release. The 
next Board meeting is scheduled for February, and once we have their 
agreement, we’ll be able to move forward and provide you with the reports 
as promised.

 

 

 

We understand the anticipation, and we appreciate your patience in this 
matter. We’ll make sure to keep you updated as soon as we have further 
information.

The reports referred to in our correspondence on 17 March 2025 are the
reports you requested in OIA request 2024/59. These are the two audits on
post-election and enrolment processes and contract management and third
party risk management.

 

The Commission will notify you and make the reports available to you when
the active development and refinement stages are complete.
