Dear Accident Compensation Corporation,
My interest is in regard to Outstanding Claims Liability (OCL) in addition to the Investment fund.
Please advise the following;
a). is the investment fund primarily their to meet ACC's OCL should it be needed,
b). apart from ACC no longer collecting levies, accepting new claims and the OCL being used to manage exisiting claims, what other circumstances has ACC identified that would need to use the OCL fund for the purpose it was created,
c). does ACC have any basis for ceasing to collect levies or accepting new claims, if so please provide details and rational,
d). why is the fund used for projects that benefit the Government or that the Government is unable to fund,
e). if ACC never stops collecting levies or accepting new claims, why does ACC need an Investment fund of $50bn

With the way your request is currently worded, we are unsure what
information in particular you are seeking. As per guidance from the Office
of the Ombudsman, information you are requesting must be specified with
‘due particularity’. This means that the person receiving the request must
be able to identify the information you have asked for. A request that
lacks due particularity will not be valid and the requirements of the Act
will not apply.
Further, under the Act a distinction exists between a request for
information already known and held by an agency (official information),
versus a request for an agency to form an opinion or provide an
explanation or comment, and thus create new information to answer a
request (not official information). Your request, as it stands, asks ACC
to provide an explanation or justification and is therefore not considered
to be requesting official information under the Act.
