Dear Auckland International Airport Limited,

On 16 august 2016, in response to a question in Parliament about the Airport Authorities (Publicising Lost Property Sales) Amendment Bill, MP Nuk Korako claimed that "the Auckland Airport authority has actually contacted me and said what a great idea this was". I would like to request the following information under LGOIMA.

* all advice and communications about the Airport Authorities (Publicising Lost Property Sales) Amendment Bill. I'm particularly interested in seeing whether you contacted Mr Korako as claimed.

I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.

With regards to s12 of the OIA, I am an NZ citizen and in NZ.

Thanks for your email yesterday in relation to the Airport Authorities (Publicising Lost Property Sales) Amendment Bill.

Auckland Airport is not subject to either the Official Information Act 1982 or the Local Government Official Information and Meetings Act 1987.

If you would like to provide me with more information about your concerns, then I can try and address them.

Thanks for your response, in which you claim that you are not subject to the OIA. According to your entry at the companies office, 41.17% of Auckland International Airport is owned by New Zealand Central Securities Depository Limited, a wholly owned subsidiary of the Reserve Bank of New Zealand (which is part of "the Crown" under the Public Finance Act), and 22.37% is owned by Auckland Council Investments Ltd, which is a Council Controlled Organisation. You therefore appear to fall into the class of "Airport companies (as defined in section 2 of the Airport Authorities Act 1966) in which more than 50% of the ordinary shares are owned by, or by any combination of, the Crown, any local authority (as defined in section 2 of that Act), or any council-controlled organisation (as defined in section 6 of the Local Government Act 2002)", and are covered due to Schedule 1 OIA.

If this is incorrect, please let me know. Otherwise, I'm happy to take this to the Ombudsman.

Hey Alex,

Not sure if your interpretation of the NZCSD holding is correct, from AIA's Annual Report Financials:

"New Zealand Central Securities Depository Limited (NZCSD) is a depository system that allows electronic trading of securities to members. As at 30 June 2016, the 10 largest shareholdings in the company held through NZCSD were:" ACC/NZSF are the only Govt agencies that have shares via NZCSD, which makes Govt ownership 26.48%...

I do see your logic, but it was only until I looked at the Financials that I saw that footnote which I think would exclude most of those NZCSD holdings from been counted, since it's involvement is only 'on behalf', the Govt for the most part doesn't OWN those shares.

Would make an interesting test case with the Ombudsman though.
