I refer your request for information received by Horizons Regional Council
on 24 August 2018. The details of your request are detailed below:

 

Original Request Detail

 

Dear Horizons Regional Council,

Please provide all documentation relating to your investigation of Land
Meat NZ illegally discharging wastewater into the Whanganui River.

In relation to your request I advise that Horizons will not be releasing
its information in relation to the investigation into Land Meats New
Zealand. This information is being withheld under section 6(a) of the
Local Government Official Information and Meetings Act 1987 (LGOMIA),
which states:

 

Good reason for withholding official information exists, for the purpose
of [1]section 5, if the making available of that information would be
likely—

(a)  to prejudice the maintenance of the law, including the prevention,
investigation, and detection of offences, and the right to a fair trial

 

The investigation file contains information such as investigative
interviews, file notes, witness statements, and other documentary evidence
and releasing them, would prejudice the ability of Horizons to investigate
and detect offending.

 

However,  it is open to you  to approach the District Court, and request
that it provide a copy of the information that was presented to it (and
therefore is part of the official court record) during the recent defended
hearing. You can do this by an application to access and view the Court
file.

 

The evidence presented in Court is the relevant evidence gathered in the
course of the investigation.
