Emails and analysis regarding Births, Deaths and Marriages Act

Human Rights Commission,

I request a copy of all analysis you have done on how changes to the Births, Deaths and Marriages Bill/Act in favour of one step sex-self ID impact women and girls sex-based human rights.

I request a copy of all emails you have sent or received which mention the BDMRR Act, Bill or sex self-declaration from 1 January 2018 to today. I am particularly interested in seeing emails which mention the Births, Deaths and Marriages Bill and women and girls rights in the Human Rights Act.

I would like to see all emails between HRC staff and the Office of the Privacy Commissioner regarding the Births, Deaths and Marriages Bill/Act, and all emails between HRC staff and Crown Law regarding the Births, Deaths and Marriages Bill/Act or sex self-declaration (from 1 January 2018 through to today).

Please include a copy of your social media policy. How many people manage your social media accounts, and (in the interests of assessing gender balance at the HRC) what sex are those people?

Since 1 January 2018, how many incidents of sexual harassment or abuse have occurred between HRC staff? How many of the staff who sexually harassed or abused women are still employed by the commission?

In a previous OIA response to me, you stated "The Commission acknowledges sex and gender are different". Is this still your stance? Your social media person continues to refer to 'gender changes' on birth certificates, though the changes on birth certificates relate specifically to sex.

You previously requested from the Human Rights Commission;

1.                   All emails between Commission staff and the Office of
the Privacy Commissioner and/or Crown Law which mention the Births,
Deaths, Marriages and Relationship Registration (BDMRR) Bill or Act or sex
self-declaration from 1 January 2018 through to 28 February 2019,
particularly those that mention women and girls rights in the Human Rights
Act.

 

Emails on the Births, Deaths and Marriages Bill and Act, sex
self-declaration and Human Rights Act

The Commission has identified a number of emails mentioning the BDMRR
Bill, and sex self-declaration between 1 January 2018 and 28 February
2019.

We have not identified any emails which mention the specific term sex
self-declaration; however, we have identified a number of emails
mentioning or about sex self-identification, transgender
self-identification or self-identification relating to sex or gender
generally.

 

Communications with external third parties

We have decided to refuse your request under section 9(2)(ba)(i) of the
Official Information Act on the grounds that there was a mutual
understanding of confidence in the provision of communications between
externals who contacted the Commission and the Commissioner generally.

We have assessed that release of this information would likely prejudice
the supply of similar information both from the same source or other
sources in a similar position.

More generally, we are of the opinion that it is in the public interest
that the information of this nature should continue to be supplied in
order for the Commission to carry out its statutory functions under s5 of
the Human Rights Act 1993. We also consider it is in the public interest
that this information of this nature is continued to be provided to the
Commission in order for the Commission to carry out its statutory duties
under the Human Rights Act 1993.

Finally, we consider that other public interest considerations do not
outweigh the need to withhold the information you are requesting.

 

Other communication

We have decided to refuse your request under section 18(f) of the Official
Information Act on the grounds that that the information requested cannot
be made available without substantial collation or research.

As we have not heard from you in relation to previous correspondence, we
will now be closing this matter.

 

Alternative avenues

If you are unhappy with this response, under the Official Information Act
you are entitled to complain to the Ombudsman’s Office. Information about
how to make a complaint is available at www.ombudsman.parliament.nz or on
