entrapment on parking in Ellerslie
Grace Haden made this Official Information request to Auckland Transport
The request was successful.
From: Grace Haden
Dear Auckland Transport,
Ticket number 3012169182
I have received a computer generated response letter which is not signed by any identifiable person and which appears to completely ignore the content of the letter I wrote in on.
I wish to know by way of LGOIMA why you have a very large sign which says p30 ends and have small signs placed in an obscure position which state p60
I am aware of the the fact that the vehicle was parked over 60 minutes but was entrapped by the signage.
By way of LGOIMA please advise when and how the officer 1046 was given enforcement powers, please supply a copy of his warrant or authority to act as an enforcement officer . Also please advise under which statute Auckland transport acquired law enforcement powers.
With regards to the the area designated P60 please advise when it was passed in council as to this area becoming a P 60 and why was the decision made to place the signs high up on the posts and parallel tot he footpath so that the signs could not be read.
and also please provide an explanation as to why there is a very large sign which say P30 ends when this sign could as easily have said p60 begins and prevented me from being misled.
further the portal on the Auckland transport web site through which tickets can be challenged is further entrapment in seeking people to identify who they are and admit to an offence by way of LGOIMA please advise why you are exempt from giving people a warning that they are admitting to an offence by filling in the form and giving away their full identity.
I wish to advise you that I will not take any action on the above mentioned ticket until you have responded to my request. You totally ignored my first request and I want this matter dealt with by a person not an automated system.
Yours faithfully,
Grace Haden

Dear Trevor,
Thank you d\for your response, I totally understand and accept that there is a process for collecting unpaid fines but as a former Police Sergeant I know that you cannot collect a fine until it is a fine and when it is due.
I had disputed the ticket and in Fact you waived the ticket because you had no legal basis for issuing it in the first place.
I wrote in no less than three times .
the fine was not outstanding it was being disputed but despite this you sent it to collection. THIS IS WHAT I AM AM QUESTIONING- YOUR RIGHT TO SEND OFF A TICKET TO COLLECTION WHILE IT IS UNDER DISPUTE !.
please provide the information requested in terms of the fact that- Nothing was owing and no offence had been committed . what right have you got in such a case to send details off to third parties.
I look forward to your response urgently
Yours sincerely,
Grace Haden

Oh and nice try on what you used to do for a job in the Police - big whoop. No one cares and I am sure the Council hear that one alot too. Pay the fine.

if you actually read what was going on you would not be going off half cocked
you have missed the point entirely.

Surely if you admit (which you have done), to parking for more than 60m but complain about the seemingly hidden signs, you would have been ticketed also for the 30m parking infringement as well. The 30m signs being large - however you also chose to ignore them in parking for more than 60m.
Case closed.
