You asked how much fuel and water was used during the response to the
Pigeon Valley fire.  Fire and Emergency only holds partial records to
answer these questions.  We can prepare the figures based on what we do

Your request for information dated 13 April has been transferred to Tasman
District Council by the Department of the Prime Minister and Cabinet
because it appears to be more closely connected with the functions of this
authority or of organisations that fall under its control.

 

The request for information is deemed to have been received on the date of
transfer, ie. 1 May 2019.

 

Under The Local Government Official Information and Meetings Act (LGOIMA),
your request must be dealt with as soon as is reasonably practicable and
in no case later than 20 working days after the day on which the request
is received.  20 working days excludes Saturdays and Sundays, Public
Holidays and the period between 20 December and 10 January inclusive.  On
this basis, we calculate a response to your request received is due by 29
May 2019, at the latest.  We shall of course endeavour to process your
request as quickly as staff resources allow but we anticipate we may need
to extend the statutory time to allow for consultation with other
parties.  For example, Nelson City Council and this Council are
responsible for the Civil Defence and Emergency Management Group which
largely operates as a separate entity.  If an extension of time is
required, we will notify you on or before 29 May 2019.

 

For requests that are likely to involve substantial collation and/or
research, there may be a charge for staff time.  Under our charging
policy, staff time for the first hour is free of charge.  Thereafter this
will be charged at the prescribed rate of $38 (GST inclusive) per half
hour.  In addition, there will be photocopying charges at 20c per sheet,
with the first 20 pages being copied free of charge.  Under clause 13(4)
of LGOIMA we do have the ability to request the amounts due are paid in
advance of the release of information.   Please be assured that if a
charge is likely to apply you will be notified ahead of the request being
processed so that you can decide if you wish to proceed.  At that time you
will also be given the option to refine your request.

Further to our previous acknowledgement of the part transfer of your
request, in relation to point 1 in bold type, our response is shown in red
below:

- what the response cost civil defence (and other responding
organisations, if possible)

 

Costs that fall within the scope of your request have yet to be
finalised.  This is because costs relating to the Pigeon Valley fires are
still being incurred and processed. 

 

We are due to meet with Nelson City Council to discuss how and when these
can be quantified for the purpose of reporting to our respective
Councils.  We anticipate to be in a position to do so at the Tasman
District Council meeting scheduled for 2 August 2019.  The report
containing those details will be available as part of the Council agenda
uploaded to our website at least two working days prior to that meeting
date. 

 

Our response is therefore that the information will soon be publicly
available and so section 17(d) of the Local Government Official
Information and Meetings Act 1987 (LGOIMA) applies to this part of your
request.

 

For clarity, your other requests are recorded but it is noted responses
are due from other organisations, as follows:

-          how much fresh and marine water was used FENZ

-     how much fuel was used by helicopters and other vehicles FENZ

-     how many hectares of forest were destroyed FENZ

Finally, we continue to work on a response to your question – ‘the
expected compensation to landowners for damage caused by the response.’ 
It is possible that the information you seek cannot be quantified but we
are carrying out consultation with other organisations, including Civil
Defence Emergency Management and Nelson City Council to ensure a proper
response can be given.    For that reason we have applied an extension of
time for our response under section 14(1)(b) of the Local Government
Official Information and Meetings Act 1987 (LGOIMA) of a further 20
working days.  This means a response will be due on or before 27 June
2019.

You have a right to refer the application of the extension of time to the
Ombudsman if you do not consider it is reasonable in the circumstances. 
Section 27(3) of LGOIMA refers.

In relation to the balance of your request (highlighted in yellow below,
for ease of reference), our response prepared by our Recovery Manager, is
as follows:

 

“…The damage caused by the response has been fully compensated with
funding from the Lotteries Grants Board.   To be very clear this funding
is to remediate private land, fences, pipes and pasture that was damaged
in the creation of firebreaks to contain the fire.   The Lotteries Grants
Board allocated $1 million for this and other community related costs and
we estimate that the cost of the land remediation will total around
$750,000…”

 

I must advise you of your right to complain to an Ombudsman if you do not
believe you have been given a reasonable response to your request.  This
right to complain is dealt with in section 27 of the Local Government
Official Information and Meetings Act.
