Dear West Coast District Health Board,
Pursuant to the Official Information Act 1982 please provide copies of all Asbestos Management Plans prepared under Regulation 13(2) of the Health and Safety at Work (Asbestos) Regulations 2016 for all workplaces occupied or from time to time occupied by the District Health Board where asbestos or ACM (Asbestos Containing Material) is suspected to be or has been identified at the workplace.

For reasons I'm unaware of this request has been handled by the Canterbury DHB who've responded, but not released the requested information.

No acknowledgement was received, nor any direct correspondence. A letter from West Coast DHB was received as part of the the Canterbury DHB response.

I am still awaiting your acknowledgment.
The information provided to me via the Canterbury DHB release is unsatisfactory.and will be referred to the Ombudsmans Office in the next 7 working days if nothing s heard from the West Coast DHB.

Dear Mark
The West Coast DHB response to your Official Information Act request WCDHB
9395 was sent to you on 2 March 2020. (see attached)
At the time of your request to WCDHB we were not receiving them from
FYI.org.nz. I did receive an alert that you had sent the same request as
to CDHB re asbestos and actioned it, but because we did not receive the
actual request we didn’t have the email address to respond to.
Consequently the response was sent to the same address as we used for the
Canterbury response.
We have since found the error with FYI.org.nz and they have corrected the
issue.

Thanks for your response, it is appreciated.
As to the absence of a Asbestos Management Plans prepared under Regulation 13(2) of the Health and
Safety at Work (Asbestos) Regulations 2016 I must point out that this has been a legal requirement to have in place since 4 April 2018, I urge the DHB to achieve compliance with that requirement as soon as reasonably practicable as there a penalties of up to $50,000 prescribed in the Regulations.
