I also refer to your request transferred from Rt Hon Jacinda Ardern, on 19 February 2020 for:
any reports or aide memories received by your office since 1 February 2019 relating to the future of Radio New Zealand Concert, including but not restricted to options on staffing, funding, coverage or the frequency or medium on which the service is broadcast.
The OIA requires that we advise you of our decision on your request no later than 20 working days after the day we received your request. Unfortunately, it will not be possible to meet that time limit and I am therefore writing to notify you of an extension of the time to make our decision.
This extension is necessary because consultations required to make a decision on your request are such that a proper response cannot reasonably be made within the original time limit.
This extension has been made under section 15A(1)(b) of the OIA. You can expect to receive a response to your request by 28 April 2020, earlier if possible.

Thank you for your letter of 28 April letting me know that a decision had been made about my OIA requests of 13 February (to the Minister) and 19 February (to the Prime Minister).
It is now two weeks since the decision was made and the information requested has still not been supplied to me or published on the MCH website, though I note that Radio New Zealand has now released a batch of information covering much of the same ground.
Public authorities are under an obligation to release information without undue delay, once a decision has been made. Consequently, if I have still not received anything by close of business on Tuesday 19 May, I will refer this request to the Ombudsman for consideration.

regards to an OIA request sent to Minister Faafoi’s office on 9 February
for; Could you please provide me with copies of all reports received by

Zealand Concert. This is to include, but not be restricted to, reports
covering the service's range of service, funding and method of
broadcasting. Reports may be from the board or management of Radio New
Zealand or from officials in MBIE, the Ministry of Culture or elsewhere in

I’m sorry that this request had not been referred to in my ongoing
communications to you regarding the status of your other two OIA requests
as set out below. Unfortunately your additional request was not forwarded
to me to progress. I apologise for the lack of response on this particular
request. Given the high volume of requests and correspondence we received
at the time, I believe there was an unfortunate oversight. However, I note
your request transferred to Minister Faafoi’s office from the Prime
Minister on 19 February for: any reports or aide memories received by
your office since 1 February 2019 relating to the future of Radio New

Dear Mr Sergeant,
I am contacting you about your requests for information, made to the
office of the Hon Kris Faafoi. I understand you have been in contact with
the Office of the Ombudsman relating to the decisions on these requests.
Thank you for your ongoing patience as we work to process these requests.
We acknowledge that this processing has taken longer than normal due to
the Government’s response to the COVID-19 pandemic. We have made a
decision on the response to your request and we are working very hard to
provide this as soon as we can.
In the interests of providing further clarity to you, I am outlining the
sections of the OIA that some of the material has been withheld under.
- 9(2)(a) to protect the privacy of natural persons.
- 9(2)(ba)(i) to protect information which is subject to an
obligation of confidence or which any person has been or could be
compelled to provide under the authority of any enactment, where the
making available of the information would be likely to prejudice the
supply of similar information, or information from the same source, and it
is in the public interest that such information should continue to be
supplied.
- 9(2)(b)(ii) to protect information where the making available
of the information would be likely unreasonably to prejudice the
commercial position of the person who supplied or who is the subject of
the information.
- 9(2)(f)(iv) to maintain the constitutional conventions for the
time being which protect the confidentiality of advice tendered by
Ministers of the Crown and officials.
- 9(2)(g)(i) to maintain the effective conduct of public affairs
through the free and frank expression of opinions by or between or to
Ministers of the Crown or members of an organisation or officers and
employees of any department or organisation in the course of their duty
- 9(2)(k) to prevent the disclosure or use of official
information for improper gain or improper advantage. This relates to an
email address that, if emailed, would send a message to all Radio New
Zealand staff.
Some material is also removed as it is note within scope of the request.
As stated, the formal advice the Ministry for Culture and Heritage has
provided to the Minister of Broadcasting, Communications and Digital Media
will be proactively release on the Ministry’s website shortly. We will
provide you with a link to this information once it is available.
I look forward to being in touch with you as soon as possible with the
requested documents.

I refer to your request under the Official Information Act 1982 (OIA),
dated 13 February 2020 for:
Could you please provide any record held by your office of any meetings
held with members of the Board and management of Radio New Zealand since 1
January 2020. This should include notes or minutes of the meetings and any
subsequent communications from your office to anyone at Radio New Zealand
describing the discussion and any decisions made at the meeting or
meetings.
I also refer to your request transferred from Rt Hon Jacinda Ardern, on 19
February 2020 for:
any reports or aide memories received by your office since 1 February 2019
relating to the future of Radio New Zealand Concert, including but not
restricted to options on staffing, funding, coverage or the frequency or
medium on which the service is broadcast.
This email is to advise that a decision has been made in accordance with
the OIA. The information in scope of your request will be provided to you
after being administratively processed. This is taking longer than
anticipated due to the government’s response to the Covid-19 pandemic.
Formal advice provided to this office by the Ministry for Culture and
Heritage will soon be made publicly available on the Ministry’s website at
[4]https://mch.govt.nz/proactive_releases. Therefore, these documents have
been refused under section 18(d) of the OIA - that the information
requested is or will soon be publicly available.
Other documentation, including correspondence within scope of your request
will be released in accordance with the OIA shortly.
Some material has been withheld in accordance with section 9 of the OIA.
In these cases, any public interest has been considered as per section
9(1) of the OIA.
You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
