Official Information Request – RFS 3998900 – Contact with the Minister for
Regional Economic Development
I refer to your information request received 4 March 2020, which has been
referred to Legal Services for consideration in accordance with the
provisions of the Local Government Official Information and Meetings Act
1987 (‘the LGOIMA’).
Information request
You requested the Far North District Council (the ‘Council’) provide:
“all correspondence including but not limited to emails, letters, meeting
notes, phone records and transcripts between the Far North District
Council and the Minister for Regional Economic Development, his staff or
any persons acting on his behalf in relation to the Provincial Growth Fund
since 26 October 2017.”
Council’s response
After considering your request, Council advises that it is simply not
possible to comply with this request as it stands. Council has determined
that what you have requested relates to such an enormous amount of
information that there would be insurmountable difficulties in searching
for and locating it.
Council does not have the resources available to manage this task; and the
impact of endeavouring to manage the request on the Council’s operations
would be severely disruptive.
In arriving at this outcome, Council also gave due regard to sections 17A
and B of the LGOIMA. Although the Council considered whether to fix a
charge under section 13 of the LGOIMA, and or whether to request an
extension under section 14 of the LGOIMA could resolve the issues; the
difficulties in actually coming up with the requested information were, in
the Council’s view, totally overwhelming. Although you may wish to refine
the scope of the request, this would need to be to a hugely significant
degree and be such that it would effectively amount to a new request.
Therefore, Council has decided to refuse your request for administrative
reasons. This decision is made pursuant to section 17(f) of the LGOIMA,
which provides that:
Section 17 Refusal of requests
“A request […] may be refused only for 1 or more of the following reasons,
namely: […]
(f) that the information requested cannot be made available without
substantial collation or research: […] “
You have the right to seek a review by the Ombudsman of this decision.
