Have there been any prisoners charged following the Waikeria prison riots?
The Ministry of Justice has interpreted your request as meaning criminal charges laid by the Police. I apologise for the delay in acknowledging your request.
I have transferred your request to the New Zealand Police. The information to which your request relates to is not held by the Ministry of Justice and in these circumstances, we are required by Section 14 of the Official Information Act to transfer your request.
You will hear further from the New Zealand Police concerning your request. If you need to contact the Police, they may be reached on [email address]
I consulted with the Department of Corrections regarding your Official Information Act request. Corrections confirmed that people in prison can be charged by Corrections staff with a misconduct, which is considered by a visiting justice within the prison and may result in penalties resulting in loss to privileges beyond minimum entitlements (less access to phone calls, visits, recreational activities, etc.). Corrections advise that none of the prisoners involved in this event have had a misconduct laid at this stage, i.e. at the time of writing. Corrections have interpreted your request as meaning criminal charges laid by the Police, rather than misconducts laid through the internal Corrections disciplinary system. I have therefore not undertaken a partial transfer to the Department of Corrections.

Information Act 1982

Have there been any prisoners charged following the Waikeria prison riots?
I have considered your request under the OIA 1982, and can advise you of
the following;
* I have noted your interest in the narrative of the Police file
* 17 offenders have been jointly charged with Rioting, Riotously
Destroys Property, Willfully Sets Fire to Property
and Committing Burglary with a Weapon in relation to the incident at
Waikeria Prison.
* The offenders details are withheld at this time pursuant to S.6(c) of
the Official Information Act 1982 as the matter is before the Courts
* This case is currently assigned to the Criminal Investigation Branch.
Please consider this request now closed.
You have the right to ask the Ombudsman to review my decision if you are
not satisfied with Police’s response to your request.
