DECISION
1. At this time, the Civil Aviation Authority has not received any
requests to disestablish the airspace within the Gisborne Control
Region or the associated approach service during the time period of
November 2021 to June 2022. This element of your request is therefore
refused in accordance with s 18(e) of the Official Information Act
1982 as the information you have requested does not exist.
2. Controlled Airspace is not 'shutdown'. However, it may be temporarily
disestablished should there be an interruption to the air traffic
control service. This might be in the event of an emergency evacuation
of the airport or the air traffic control tower, or a similar
unforeseen circumstance. In such events, the airspace automatically
changes from controlled airspace to restricted airspace. In this
situation the airspace is not "closed" or "shutdown" it has restricted
access to allow only a minimum level of aviation activity.
[1]Civil Aviation Rule Part 71 allows the Director of Civil Aviation to
designate restricted use of airspace on the grounds of aviation safety and
security, national security or the public interest. The restricted
airspace is promulgated by way of a Notice to Airmen (NOTAM) issued by
Airways Corporation.
[2]Part 71.7 outlines the process for application. Any person with a bona
fide interest in airspace may apply to the Director for a classification
of airspace under this Part. When completing an application, the applicant
must provide the following details:
1. The name and contact details of the applicant
2. The type of designation or classification required
3. The reason for the designation or classification
4. The dimensions or other boundary information for the airspace that
is required
5. The period for which the designation or classification is required
6. The contact details of any applicable administering authority or
using agency
7. Any other applicable information required by the Director
With the exception of urgent requests such as those associated with Police
or other emergency situations, an application must be submitted no less
than 90 days before the date in which it is to come into force. Before
making any designation or classification, the Director must follow the
procedure in [3]Part 71.9.
