Dear Ministry of Justice,
I am making this request under the Official Information Act.
I am requesting tables containing the following information:
- List of individuals/organisations that have filed a private prosecution, and the sum total of the private prosecutions filed for each of these individuals/organisations.
- A list of offences that private prosecutions have been filed for, along with the sum total of private prosecutions filed for each offence, grouped by calendar year.
For the purposes of this request, the time period should be interpreted as being between the Criminal Procedure Act 2011 coming in to force, until 31 October 2021.
For the purposes of the Act, I am a New Zealand citizen currently residing in New Zealand.

Good afternoon Mr Holmes,
Thank you for your request under the Official Information Act received to
the Ministry of Justice on 1 November 2021.
To produce the data, we need to clarify what you are requesting. The
issues are as follows;
1. The Criminal Procedure Act came into place July 2011. If we run the
data by calendar year we will not get very many observations for 2011
because we are basing the date of charge outcome. (I.e. because the
legislation just came into place many cases will still be pending). We
would also have to take into account there will be a ‘transition
period’ of when the legislation came into place.
2. We will also only be able to provide data up till December 2020.
Could you please advise if this is what you are requesting and are happy
to receive data on this basis?

Thanks for following up on this.
Yes, I accept there will be fewer numbers around 2011 due to the CPA Act coming into force and the subsequent transition period.
Providing data until December 2020 is acceptable for this request.
