Dear Ministry of Health,
Under the Official Information Act, I request the following information:
1. How many people (if any) in managed isolation and quarantine (MIQ) have been detected to have COVID-19 (SARS-CoV-2) via PCR test after day 12 of arrival in NZ following a previous negative result, where exposure during those 12 days has not occurred (e.g. as a contact of family member testing positive)?
2. How many people (if any) in MIQ have been detected to have COVID-19 (SARS-CoV-2) via PCR test after day 10 of arrival in NZ following a previous negative result (e.g. as a contact of family member testing positive)?
3. How many people (if any) in managed isolation and quarantine (MIQ) have been detected to have the omicron variant of COVID-19 (SARS-CoV-2) via PCR test after day 12 of arrival in NZ following a previous negative result (e.g. as a contact of family member testing positive)?

This data is not available in the format requested, as such your request
is refused under section 18(g)(i) of the Act, as the information requested
is not held by the Ministry and there are no grounds for believing it is
held by another agency subject to the Act. To provide this information to
you would require a significant amount of work to collate the data and
involve collation across multiple data sets in order to provide the data
in the format requested. Please also be aware, there is no requirement for
the Ministry to create information in order to respond to an OIA request.

Thank you for your response. Could you please clarify the grounds on which you are declining the request. You have cited s18(g)(i) - that the information requested is not held. However, you have also stated that it would require substantial collation and research in order to produce the data. If the data does not exist, presumably is cannot require time to collate it.
Furthermore, you have stated that you cannot provide it in the format requested. Could you please advice under what format you can provide the information requested?
Are you also able to explain why it has taken 99 days to decline the request? It is suspicious that your decline email was sent less than 24 hours of me chasing you for your significantly overdue response.
I look forward to hearing from you on the above matters.
