Dear Nelson City Council,
Waimea Water is a Council-Controlled Organisation established in November 2018 to manage the construction, operation and maintenance of the Waimea Community Dam.
Waimea Water represents the shared interests of Tasman District Council (majority shareholder) and Waimea Irrigators Ltd to oversee and manage the Waimea Community Dam’s development, construction and operation.
The Waimea Water web site promotes the benefits of this project, but the most recent quarterly report currently is dated March, 2022. As Nelson City Council is a major contributor to the Waimea Dam project, I would expect it to have the quarterly or annual reports for the periods ending June, 2022 and September 2022.
Please provide me a PDF copy of those reports, and have Waimea Water make these reports accessible to the public as soon as possible. Please consider this to be a time sensitive request. The documents must already exist. The dam is still an issue that voters will consider in the October elections.

Kia ora Bruce,
We acknowledge receipt of your requests for information, including those
recently transferred from Nelson City Council and Tasman District Council.
We can confirm that reporting is provided for in the Statement of Intent
which you can find on Waimea Water Limited’s (WWL) website. We provide
regular updates to shareholders and the public which you can also find on
our website. The benefits of the Waimea Community Dam are unchanged and
as described on our website. We advise our shareholders of any cost
increases as soon as reasonably practicable and not only at the time that
we provide accounts in line with statutory obligations.
The March 2022 report is for the 3 Months ended 31/03/2022. The June 2022
report is the Annual Report and is subject to review by auditors. Under
the Local Government Act 2002, this report is not due to be provided to
shareholders until 30 November 2022. The September 2022 quarterly report
is due to be provided to shareholders within two months of the end of the
September quarter ie. by 30 November 2022. Once the reports have been
released to shareholders they are then made available to the public by
WWL. Tasman District Council also places a copy or a link to the reports
on its website.
We will endeavour to release the Annual Report as soon as we can, although
release is subject to delays with the audit process. Annual accounts are
not released until reviewed and aligned with the auditor’s requirements,
which is common company practice.
In terms of our decision on your requests under the Local Government
Official Information and Meetings Act 1987, these are refused on
administrative grounds under section 17(d) of the Local Government
Official Information and Meetings Act (LGOIMA) – the information will soon
be publicly available.
I must advise you of your right to complain to an Ombudsman if you do not
believe you have been given a reasonable response to your request. This
right to complain is dealt with in section 27 LGOIMA.
