requesting, under the Official Information Act 1982 (the Act), the

I request all cabinet papers that mention Refugee Claimants from 1995 to

We are writing to give you the opportunity to clarify your request because
we consider that the information in scope of your request cannot be made
available without substantial collation or research. We understand that on
30 August 2023, the Ministry of Business, Innovation and Employment
(MBIE), the agency which assists this office in answering such requests,
contacted you to discuss your request. We understand from that
conversation that you are specifically interested in the public services
available to refugee claimants and how they may have changed over time. We
consider that this information may be contained in documents other than
Cabinet papers and that significant searches may be required to locate
them. However, we may be able to provide some information in scope of such
a request. Could you please confirm in writing whether this is an accurate
description of the information you are seeking.
Unless your request is amended, your request may be refused under section
18(f) of the Act, as the information cannot be made available without
substantial collation or research. Please note that any clarification or
amendment of a request will be considered a new request for the purpose of
calculating the maximum statutory timeframe for response as per section
15(1AA) of the Act.

have received advice today that the Ministry of Business, Innovation and
Employment (MBIE) has been able to locate a number of MBIE documents in
scope of your request.

this office but is believed to be held by MBIE. In these circumstances, we

I am following up on your phone call with my colleague today regarding
your OIA request for “policy documents or correspondence that discuss
refugee claimants’ access to services such as education, health and social
welfare” for the period 1995 until 24 August 2023, which was transferred
to the Ministry of Business, Innovation and Employment (MBIE) on 20
September.
Based on your discussion our understanding is that, due to the time that
would be required to undertake a comprehensive search and in order to
expedite your request, you are happy to refine your request to be limited
to information that we have currently identified, and therefore is readily
available, within the scope outlined above. We would appreciate if you can
please reply and confirm that this is correct.
Once you have had an opportunity to review this material we would be happy
to receive further requests if you identify any more information you are
interested in.
This will not affect the scope or processing of your other OIA request to
MBIE for “any discussion documents between 1995 - 2002 that speak about
the access to services and rights given to refugee claimants whilst they
are in the process of claiming refugee status” (ref: DOIA 2324-0371),
which may identify further documents.
We also understand that you do not wish MBIE to transfer your request to
any other agencies at this stage. And that you may want to make further
requests to other agencies yourself once you have reviewed this
information.
