We want to try and ensure that you receive the type of information you are
expecting.
Subpart 3 of the Marine and Coastal Area (Takutai Moana) Act 2011 (the
Act) requires the chief executive of Toitū Te Whenua Land Information New
Zealand (Toitū Te Whenua) to maintain a marine and coastal area register
(the Register) as a permanent record of documents relating to customary
marine interests. The Act requires the Chief Executive to enter a document
on the Register without delay after receiving a document, or after an
agreement is brought in force under the Act.
You have requested all information relating to the Marine and Coastal Area
Register, narrowed specifically to orders made under the Act, and the Ngā
Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019. The information Toitū Te
Whenua holds relating to the Register and orders made under both Acts
largely concerns administrative material related to receiving documents
for publication and arranging for these to be published on the Register.
We are happy provide this administrative material if that is what you
want. However, we are wondering whether your areas of interest are more
focused on process, policy, approvals, and maps.
Therefore we are seeking clarification as to exactly what material
seeking.

The Marine and Coastal Area (Takutai Moana) Act 2011 requires a Customary
Marine Title order, issued by the Court, to include a Survey Plan.
To date only one Recognition Order, in 2018, has been supported by a
Survey Plan

The documents supporting that Survey Plan are available through
Landonline. Nevertheless, I have attached a key document from the Office
of the Surveyor-General to assist you. Does this answer your request, 'I
want to see all communications of the Surveyor General and the Office of
the Surveyor General that relates to the orders concerned'?
As indicated in the recently published Mapping Guidance, the
Surveyor-General is now developing new Cadastral Survey Guidance for the
preparation of such Survey Plans. Those Guidelines will be heavily
informed by the analysis in the Mapping Guidelines. Until they are ready,
he plans to deal with any Survey Plans through the dispensation process
which will involve engagement with the relevant surveyor. This will also
help inform the content of the Guidelines.

QUESTION. Please explain this comment. I am not a lawyer, but my reading is that a survey plan is required for both orders of the Court and of orders through direct engagement and of orders of the Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019. Is my interpretation incorrect?

QUESTION. What is the status of the orders that are not supported by a survey plan?

RESPONSE. No, this does not answer my question. I wish to see the communications between the Surveyor General and any other party that addresses the issue of the orders that were not supported by survey.
RESPONSE. I see from the attached document that the cadastral boundaries of Specified Freehold Land were being adjusted to better reflect the survey SO 10461. Please provide a copy of the GIS of these areas prior and after adjustment.
As indicated in the recently published Mapping Guidance, the
Surveyor-General is now developing new Cadastral Survey Guidance for the

RESPONSE: The general subject of dispensation will be the subject of a separate OIA request.
RESPONSE: Please clarify the position of the orders that currently do not survey plans. If there has been any discussion about retrospective dispensation or any blanket dispensation such as that which occurred during the Maori Freehold Land Registration Project (LINZS10000), please indicate this.
