Car data recorder
Mike made this Official Information request to New Zealand Police
The request was partially successful.
From: Mike
Dear New Zealand Police,
Many modern cars are fitted with event data recorders (aka crash data recorders). Do NZ Police retrieve data from these when investigating a vehicle crash?
Yours faithfully,
Mike
From: Mike
Dear New Zealand Police,
My apologies I missed the second part of my question
If you do, does it require the prior permission of the vehicle owner or the driver before you access the data. Or is there legislation that allows you to access it without either the owners or the drivers consent in the event of a crash?
Yours faithfully,
Mike

Dear Ministerial Services,
Thanks for your reply. You response does answer my 2nd question but not the first i.e. Many modern cars are fitted with event data recorders (aka crash data recorders). Do NZ Police retrieve data from these when investigating a vehicle crash?
Yours sincerely,
Mike

I have checked with the workgroup that drafted your response and they have advised that Police may choose to use those powers where the legislation permits, and it is believed that doing so may provide value to an investigation.

The response does not really answer my first question i.e. "Do NZ Police retrieve data from these when investigating a vehicle crash?"
They have indicated they might if they thought its valuable. But have not indicated if they have ever retrieved data, if its standard operating procedure, or used by exception.
Enough for my purposes. But I do not consider it a reasonable response to the 1st question to meet the expectations of an OIA.
