Request for access to information held by Netsafe

 

Thank you for your correspondence of April 26, 2024 where you requested:

 1. A copy of every censoring request or order, or so called "take down"
request or order made by Netsafe to the online entities Meta,
Facebook, X (nee Twitter), Rumble, Tiktok, Instagram between the dates
of 01.01.2024 and 24.04.2024 and;
 2. A copy of any correspondence to or from Netsafe that contain any of
the following key terms: Hobson, Hobson's Pledge, Brash, Don Brash

 For your second request, to clarify and assist us in locating this
information, could you please confirm if this is also for the timeframe
between 01.01.2024 to 24.04.2024?

 

Once we’ve received confirmation from you, Netsafe will respond to your
request taking account of obligations under the Official Information Act
1982 (the Act) and Netsafe’s Privacy and Information Statement.

 

Please be aware the Act applies to information held by Netsafe only in
respect of functions and activities under the Harmful Digital
Communicaitons Act 2015 and only since that Act came into force in 2016.

 

For information that falls within scope of the Act, the Act requires that
we advise you of our decision on your request no later than 20 working
days after the day we received your request. Unfortunately, it will not be
possible to meet that time limit and we are therefore writing to notify
you of an extension of the time to make our decision to June 21, 2024,
although we will endeavour to respond sooner if we can.

 

An extension is required as this request necessitates a search through a
large volume of information, and further consultations to make a decision
on the request are necessary.  

 

You have the right to make a complaint to the Ombudsman about the
extension under section 28(3) of the OIA. 

 

Netsafe has a charging policy for Official Information Act requests, in
line with the [1]standard charging regimes set by the Ministry of Justice.
If charges are justified or likely, we will inform you of:

* our decision to release information 
* the total amount of the charges
* the basis for proposed charges

Netsafe wrote to you on 6 June indicating that we may refuse your request
under s18(f) of the Official Information Act 1982 (OIA) on the basis that
the information cannot be made available without substantial collation
or research. We requested you to let us know on or before 13 June 2024
whether you were prepared to amend or clarify your request and, if so,
how. We have not received a response to this letter and have proceeded to
make a decision on your request.   
 
Netsafe is refusing your request under s18(f) of the OIA on the basis that
the information requested cannot be made available without substantial
collation or research. 
 
You have the right to make a complaint to the Ombudsman under section
28(3) of the OIA about this refusal.
