Dear NetSafe Incorporated,

I am writing to request copies of the investigation into the alleged 'hacking' of NZ First MP Tanya Unkovich's Facebook account.

On 15/05/2024 Tanya Unkovich was quoted by RNZ (https://www.rnz.co.nz/news/political/516...) that NetSafe was investigating the alleged hacking of her social media account which led to the alleged hacker posting anti-trans activism, as well as having conversations over Messenger being actively discriminatory and aggressive towards members of the trans community.

I eagerly await the findings of this investigation, if there was even one to begin with.

Thank you for your correspondence of August 12, 2024 where you requested
copies of the investigation into the alleged ‘hacking’ of NZ First MP
Tanya Unkovich's Facebook account.
Netsafe will consider and respond to your request taking account of
obligations under the Official Information Act 1982 (the Act) and
Netsafe’s Privacy and Information Statement.  
Please be aware the Act applies to information held by Netsafe only in
respect of functions and activities under the Harmful Digital
Communications Act 2015 and only since that Act came into force in 2016. 
For information that falls within scope of the Act, the Act requires a
decision on the request as soon as reasonably practicable and in any case
within 20 working days after receiving the request, making September 9,
2024 the latest date for our response to you, unless an extension is
required. 
Netsafe has a charging policy for Official Information Act requests, in
line with the [1]standard charging regimes set by the Ministry of Justice.
If charges are justified or likely, we will inform you of:  

* our decision to release information   
* the total amount of the charges  
* the basis for proposed charges

Thank you for your correspondence of August 12, 2024 where you requested
copies of the investigation into the alleged ‘hacking’ of NZ First MP
Tanya Unkovich.
The Official Information Act 1982 requires that we advise you of our
decision on your request no later than 20 working days after the day we
received your request. Unfortunately, it will not be possible to meet that
time limit and we are therefore writing to notify you of an extension of
the time to make our decision to September 27, 2024.  
An extension is required as further consultations to make a decision on
the request are necessary.   
You have the right to make a complaint to the Ombudsman about the
extension under section 28(3) of the OIA.

Thank you for your correspondence of August 12, 2024 where you requested
copies of the investigation into the alleged ‘hacking’ of NZ First MP
Tanya Unkovich.  
  
Netsafe has considered your request in accordance with the Official
Information Act 1982 (OIA) and Netsafe’s Privacy and Information Statement
and our decision is to release information to you.    
  
In May, 2024, Netsafe received reports of Facebook accounts being set up
to impersonate NZ First MP, Tanya Unkovich. These incidents related to the
creation of new accounts using information pertaining to Ms Unkovich.
These incidents did not involve the compromise of their, or any other,
account on Facebook. By our understanding, these incidents therefore do
not relate to ‘hacking.’ 
 
We note that the media article you linked in your request
([1]https://www.rnz.co.nz/news/political/516...)
also describes the incident as having involved the creation of a fake,
impersonation account and not the compromise or ‘hacking’ of accounts.
However, as the article referred to the impersonation accounts we have
therefore considered your request as a request for information pertaining
to these impersonation incident reports.  
 
Please find attached a copies of the incident reports filed with Netsafe
related to the impersonation accounts on Facebook targeting NZ First MP
Tanya Unkovich.  
  
Some information has been redacted as not within scope of the request.
Some information has been withheld to protect the privacy of natural
persons under s9(2)(a) OIA or to protect information supplied in
confidence under s9(2)(ba). You have the right to make a complaint to the
Ombudsman about information that has been withheld.
