Part One
I am refusing your request under section 18(d)of the Act as the information requested is publicly available. Information proactively released can be found at: www.dia.govt.nz/Proactive-Release#LG.

Link was wrong - it was this:
https://www.dia.govt.nz/Proactive-Releas...

Seems it was released proactively Nov 15

Part Two
Advice on potential Government intervention at the Wellington City Council was requested in discussions with officials--not via an email or letter. Iam, therefore, refusing this part of your
request under section 18(e) of the Act, as the documents alleged to contain the information requested do not exist.

Re the 18(d) refusal of part 2

https://www.ombudsman.parliament.nz/site...

Under “Information held by employees” clearly states that information held in the mind of an employee that can be recalled should be reduced to writing and released

The above should be 18(e) instead of 18(d)

Dear Minister of Local Government, Hon Simeon Brown,

Re: Advice considered in Wellington Intervention
https://fyi.org.nz/request/28848-advice-...

I welcome the Minister to re-consider the Part Two and consider that the official information is considered as 'held'

Please see the related Ombudsman guidance:
https://www.ombudsman.parliament.nz/site...

On request, any unrecorded information should be reduced to writing and released, unless there is a good reason for withholding. Reducing unrecorded information to writing does not amount to the creation of new information. Rather, it is the provision of existing information in a different form.

I welcome the Minister of Local Government to lead and further demonstrate good governance practices and reduce this important official information into writing and release it just like governance bodies generally are required to uphold minutes for all the official decisions and considerations.

Yours sincerely,

Miss W. Forest
