Hello East Skate Club
We refer to your request for information on the tender for the Waitara
Skatepark Project which has been considered under the Local Government
Official Information and Meetings Act (the Act).
In June/July 2023 NPDC released an open Request for Information (RFI) for
design and build skatepark contractors. This was to see who in the market
was interested and had the capability to deliver for us. Three contractors
responded to the RFI (Convic, Tom Smithers Enterprises & Wrong Skate Ltd).
All three were short listed to the next phase (Requests for Proposals –
RFP).
Three RFPs were received, and all three met our requirements for the $800k
contract budget. Your request for what the price was is refused under
section 7(2)(b)(ii) of the Act, in order to protect information where the
making available of the information would be likely unreasonably to
prejudice the commercial position of the person who supplied or who is the
subject of the information. The RFPs were all evaluated in accordance with
the RFP with Convic being the successful respondent. Convic started
construction in October 2024 and finished in December 2024 within the
allocated budget.
You have the right to seek an investigation and review by the Ombudsman of
