Re: Complaint Regarding Non-Release of Police Disclosure by Prosecutor

I am writing to formally lodge a complaint regarding the failure of a prosecutor to release police disclosure in my case, which I believe constitutes a breach of my privacy rights under the Privacy Act 2020.
1. Details of the Complaint:
• Case Reference Number: 4 charges were not disclosed
• Prosecutor’s Name: sgt hickey taumaranui police prosecution services

2. Nature of the Complaint:
I have been involved in legal proceedings in which I requested access to police disclosure as part of my right to a fair trial. Despite my formal requests he asked me if I wanted a copy of the police disclosures and I stated yes because I am self representing and have no physical or digital copies of the police disclosures and 14 months later I still dont, the prosecutor has not provided the necessary disclosure in a timely manner, or at all, which has prevented me from fully understanding the evidence against me or what the charges fully are. He also accessed my private tiktok account without a warrant, sub-peona or personal consent looking for evidence and was monitored for over 3 months
This lack of disclosure has hindered my ability to adequately prepare for my defense and may have infringed upon my right to a fair trial under New Zealand law. In addition, the failure to release police disclosure appears to involve my personal information, which I believe falls under the protections of the Privacy Act 2020.
3. Specific Concerns:
• Failure to Release Information: intimidate x 2, threatening property, willful damage and theft under $500 I don’t know the crn numbers as I have not seen the police disclosures
• Request for Disclosure: I made a request for the disclosures on the 15th march 2024, 17th july 2024 and the 24th august 2024 which all 3 were not responded to I use a app link that tells me if they were opened and can confirm he opened the emails but never responded.
• Breach of Privacy: because sgt hickey was accessing and screen capturing video images from my private tiktok account with no warrant, sub-peona or personal consent to do so and even stated in a email that he had been monitoring my social media account for at least 3 months looking for evidence in a active investigation.
4. Steps Taken:
• Multiple emails to sgt hickey taumaranui police prosecution services, taumaranui pps and filed 5 complaints which have not been responded to nor have I received acknowledgement of receipt of such complaints.
5. Request for Action:
I respectfully request that the Privacy Commissioner investigate this matter and take appropriate action to ensure that my privacy rights are respected and that any personal information relevant to my case is disclosed in a timely and appropriate manner, as required by law.
I believe that withholding the police disclosure is both a violation of my rights and contrary to the principles of transparency and fairness in legal proceedings.

• Im request a copy of the warrant, sub-peona, my consent to go through the account, I have requested this from sgt hickey dated 11/12/2024 time 11:54am via email
