This should be a Ministry of Justice request, not Police.
From: MCMAHON, Teresa
New Zealand Police
Dear Mr Ryan
You had requested from Police a transcript of a summing by Judge Wiltens.
This information is not held by Police and is therefore refused under
s9(2)(g) of the Official Information Act.
The Ministry of Justice advises that access to the court record is
governed by legislation and there are specific rules around how this
information can be released. Generally speaking, the person seeking
information from the court record will need to contact, in writing, the
registrar of the court at which the case was heard. They will need to
identify the particular records they wish to access and give reasons for
their application. Court contact details can be found on the Ministry of
Justice website at the following link:
[1]http://www.justice.govt.nz/services/find....
The request will be considered by either the registrar or if necessary a
judge. Any decision relating to the release of a court record is a
judicial decision and may attract a fee. The Ministry of Justice cannot
intervene or comment on this decision making process.
I hope this advice assists you and remind you of your right to complain to
the Ombudsman if you are not satisfied with the way I have responded to
your request.
Yours sincerely
Teresa McMahon
