Letter to Dominion
Ross Francis made this Official Information request to New Zealand Police
The request was refused by New Zealand Police.
From: Ross Francis
Dear New Zealand Police,
I have the following information request.
In his reply to me of 25 January 2018, Detective Inspector David Kirby advised that:
"…an email was sent to all Specialist Child Witness Interviewers and Child Protection Coordinators throughout the country asking for any knowledge of such cases. To date, there has been one response which has identified a case regarding a daycare where allegations of sexual abuse were made by multiple children about one offender…[t]he alleged offender was prosecuted".
Have there been any additional responses after Police asked for knowledge of such cases? If so, please provide me with the details of all responses. What similarities, according to records held by police including information held in the minds of officials, exist between that case and the Peter Ellis case?
During the police investigation into Geoffrey David Scott, convicted on multiple counts of child sexual abuse in 1994, did Wellington police consult with their colleagues in Christchurch? If so, what information or assistance (if any) did Wellington police request from Christchurch police during the Scott investigation? Please provide me with all records held in respect of communication between police in Wellington and police in Christchurch regarding the investigation of Scott.
In May 1996, Wendy Burgering and Mark Copeland wrote a letter to the Dominion newspaper advising that the standard practice is to formally interview children only once. When exactly did this policy of one interview only come into effect, and please provide me with a copy of the unabridged letter from Messrs Burgering and Copeland?
Please contact me if you have any queries regarding this request.
Yours faithfully,
Ross Francis

That is outrageous! What utter bollocks! Nigel is right, I hope you make a formal complaint to the Ombudsmen about this.

Hi Ross,
I looked into the raw response and would like to point out the following:
1) There is no evidence that the e-mail address the Police used as the "From" is unmonitored, it's an email they regularly use and when I had emails via it late last year, it wasn't claimed as unmonitored
2) The 'other address' is in fact the address your request originally went to.
3) E-mail is a valid form of delivering an Official Information Request, their response can be seen as a refusal outside the allowed grounds of the OIA (i.e. they've said they will not consider the request unless you make it in another format - this isn't allowed grounds for refusal).
You have the right to reply and remind them of this (include http://www.ombudsman.parliament.nz/syste... for good measure), or if you see this as potentially wasting time given their response, go directly to the Ombudsman and make a complaint that they've refused your request without cause.
