Good afternoon Richard

Further to your enquiry, I am able to provide the information you have requested as it related to the Invercargill City Council.

What is not often well understood is that the Southland Museum is owned by the SMAG Trust which has its own board of trustees. SMAG owns the buildings and collections. ICC provides the staff under an operating agreement.

The SMAG Trust Board obtained a seismic evaluation which is dated November 2013. The chairman of the Trust Board wrote to the then CE of ICC advising him of the assessment and the Boards proposed actions on 13 December 2013 (copy attached).

Following the implementation of the changes to the building legislation in July 2017, the Trust Board requested a peer review of the original seismic assessment.

The current chair of SMAG informally advised the newly appointed CE of ICC on Monday 26 March 2018 about the peer review and sought advice. The peer review conclusion was included in the information formally received by Council on 9 April 2018 when the decision to removed staff from the building was made (copy attached).

The Building Warrant of Fitness expires on 6 April 2019.
