Resource consents for combustion discharges

Dear Tasman District Council,
The Tasman District Council controls discharges of contaminants from enclosed combustion processes under Chapter 36 of the Tasman Resource Management Plan. Rule 36.3.3.1 makes enclosed combustion a controlled activity if it complies with conditions, meaning a resource consent is automatically granted if those conditions are met. Rule 36.3.4.1 covers enclosed combustion which does not comply with other rules as a restricted discretionary activity requiring a resource consent. I would like to request the following information under the LGOIMA:
* a list of all the resource consents in force for discharges from enclose combustion under Rules 36.3.3.1 and 36.3.4.1. For each consent I would like the date of issue, date of expiry, the fuel source for the combustion, and the power in kW or MW (if known) or maximum combustion rate (e.g. in tonnes per hour, if known).
I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.

Thank you for your request for information received on 18 July 2019.
Under The Local Government Official Information and Meetings Act (LGOIMA), your request must be dealt with as soon as is reasonably practicable and in no case later than 20 working days after the day on which the request is received. 20 working days excludes Saturdays and Sundays, Public Holidays and the period between 20 December and 10 January inclusive. On this basis, we calculate a response to your request received is due by 15 August 2019, at the latest. We shall of course endeavour to process your request as quickly as staff resources allow.
For requests that are likely to involve substantial collation and/or research, there may be a charge for staff time. Under our charging policy, staff time for the first hour is free of charge. Thereafter this will be charged at the prescribed rate of $38 (GST inclusive) per half hour. In addition, there will be photocopying charges at 20c per sheet, with the first 20 pages being copied free of charge. Under clause 13(4) of LGOIMA we do have the ability to request the amounts due are paid in advance of the release of information. Please be assured that if a charge is likely to apply you will be notified ahead of the request being processed so that you can decide if you wish to proceed. At that time you will also be given the option to refine your request.

Good afternoon Alex,
I write by way of an update and apologise that it has not been possible to supply the information you have requested within the original statutory timeframe. This is because a response requires us to search through a large quantity of information and meeting the original time limit would unreasonably interfere with our day to day operations.
Consequently, we will need to apply an extension of time for a response in accordance with s.14(1)(a) of the Local Government Official Information and Meetings Act 1987 (LGOIMA). Given current resourcing and the nature of your request, we consider a further ten working days would be reasonable. This will mean a response is due on or before 29 August 2019 at the latest.
You have the right to complain about the application of this extension of time to the Ombudsman.

We do not store our consents by fuel type, this list will contain most of
the key discharges who require consent to burn fossil fuels.
Please note this is an incomplete list as several businesses can operate
boilers/generates etc as a permitted activity in accordance with the rules
in Chapter 36.3 of the TRMP. Rule 36.3.2.5 allows boilers up to 5MW
depending on fuel type and location. We generally don’t store the amount
of fuel burnt by each consent holder, this is also likely to be very
variable year to year. Most if not all the Hop processors will only be
burning fossil fuels for their harvest season, approximately 4-6 weeks.
Most of the glass houses only burn when they require heat, hence they are
not producing much if any emissions over the summer / early autumn.
We will work to provide the date of issue and expiry for each of the above
consents but our resources are still very limited in this particular
department. We will need to apply a further five working days in order to
collate that information - s.14(1)(a) of LGOIMA refers. You have the
right to complain about the application of this extension of time to the
Ombudsman.
