Consumers Rights & Physicians Obligations - Referrals and Inter-District Flow
Amy S Van Wey Lovatt (Account suspended) made this Official Information request to Ministry of Health
The request was partially successful.
From: Amy S Van Wey Lovatt (Account suspended)
Dear Ministry of Health,
According to the Health and Disability Commissioner (Code of Health and Disability Services Consumers' Rights) Regulations 1996, Right 6 clause 3 (c), "Every consumer has the right to honest and accurate answers to questions relating to services, including questions about...(c) how to obtain an opinion from another provider;". Further, Right 7 clause 8 states: "Every consumer has the right to express a preference as to who will provide services and have that preference met where practicable."
According to the MoH Operational Policy Framework 2019/20, available through Nationwide Service Framework Library <https://nsfl.health.govt.nz>,
section 7.5.2 "Regions should ensure that clear referral pathways are in place and known to all clinicians."
Request 1:
I respectfully request a copy of each referral pathway for each region in New Zealand.
Background:
I am a New Zealand citizen. Waikato DHB, my DHB of Domicile (DoD), has insisted that my GP provide a referral to services outside my DoD; however, when my GP referred me to the Southern DHB, the only DHB we could find which had a protocol consistent with the Endocrine Societies Guidelines for testing for hyper aldosteronism, the Southern DHB rejected the referral on the grounds that the referral was from my GP and not my specialist, Dr Wu, at my DoD.
Clearly, Waikato DHB and Southern DHB cannot both be correct, as they contradict each other. [The statement, referrals must be from GPs AND referrals cannot be from GPs, is logically false.]
Request 2:
Please provide me with the specific policy, guideline, rules or legislation (including page or section number) which specifies who is responsible for the submission of patient referrals to specialists, where the specialist is located in a DHB that is not the DoD, especially in the case of where two DHB's have contradicting policies.
Request 3:
Please provide me with the specific policy, guideline, rules or legislation (including page or section number) which specifies the avenues that patients may take to seek care out of the DoD, when the patient has lost all trust and confidence with the DoD.
Request 4:
Please explain how these policies are consistent with the Code of Health and Disability Services Consumers' Rights, specifically:
- Right 3, which states "Every consumer has the right to have services provided in a manner that respects the dignity and independence of the individual"; and
- Right 4 clause 3, which states "Every consumer has the right to have services provided in a manner consistent with his or her needs"; and
- Right 7 clause 8, which states: "Every consumer has the right to express a preference as to who will provide services and have that preference met where practicable".
Respectfully yours,

Dear Craig Goodwillie,
Thank you for your response.
Section 18(g) of the OIA states that a request may be refused on the grounds:
(g) that the information requested is not held by the department or Minister of the Crown or organisation and the person dealing with the request has no grounds for believing that the information is either—
(i) held by another department or Minister of the Crown or organisation, or by a local authority; or
(ii) connected more closely with the functions of another department or Minister of the Crown or organisation or of a local authority:
The MoH Operational Policy Framework 2019/20, available through Nationwide Service Framework Library <https://nsfl.health.govt.nz>, states under section 7.5.2 "Regions should ensure that clear referral pathways are in place and known to all clinicians."
Given that every DHB must "ensure that clear referral pathways are in place and known to all clinicians", clearly such policies must exist, and thus section 18(g) cannot apply to my request.
Request 1:
Thus, I request, under section 13 and 14 of the OIA that your please assist me in obtaining these policies even if it requires transferring my request to each and every DHB or another relevant agency, which would have the required information.
Request 2:
In terms of clarification of how the policies are consistent with legislation, please explain who other than the HDC would be the most relevant to provide such information.
According to section 14 of the Health and Disability Commissioner Act 1994,
(1)The functions of the Commissioner are as follows:
(a) as a first priority, to prepare a draft Code of Health and Disability Services Consumers’ Rights in accordance with section 19:
(b) in accordance with section 21, to review the Code and make to the Minister any recommendations for changes to the Code:
(c) to promote, by education and publicity, respect for and observance of the rights of health consumers and disability services consumers, and, in particular, to promote awareness, among health consumers, disability services consumers, health care providers, and disability services providers of the rights of health consumers and disability services consumers and of the means by which those rights may be enforced:
(d) to make public statements and publish reports in relation to any matter affecting the rights of health consumers or disability services consumers or both, including statements and reports that promote an understanding of, and compliance with, the Code or the provisions of this Act:
(da) to act as the initial recipient of complaints about health care providers and disability services providers, and to ensure that each complaint is appropriately dealt with:
(e) to investigate, on complaint or on the Commissioner’s own initiative, any action that is or appears to the Commissioner to be in breach of the Code or, in the case of conduct that occurred before the enactment of the Code, in breach of certain disciplinary standards:
(f) to refer complaints, or investigations on the Commissioner’s own initiative, to the Director of Proceedings for the purpose of deciding whether or not any further action should be taken in respect of any such breach or alleged breach:
(g) subject to section 15(2), to make recommendations to any appropriate person or authority in relation to the means by which complaints involving alleged breaches might be resolved and further breaches avoided:
(h) to prepare guidelines for the operation of advocacy services in accordance with section 28:
(i) to make suggestions to any person in relation to any matter that concerns the need for, or the desirability of, action by that person in the interests of the rights of health consumers or disability services consumers or both:
(j) on the Commissioner’s own initiative or at the request of the Minister, to advise the Minister on any matter relating to—
(i) the rights of health consumers or disability services consumers or both; or
(ii) the administration of this Act:
(k) to report to the Minister from time to time on the need for, or desirability of, legislative, administrative, or other action to give protection or better protection to the rights of health consumers or disability services consumers or both:
(l) to receive and invite representations from members of the public and from any other body, organisation, or agency on matters relating to the rights of health consumers or disability services consumers or both:
(m) to gather such information as in the Commissioner’s opinion will assist the Commissioner in carrying out the Commissioner’s functions under this Act:
(ma) to monitor mental health and addiction services and to advocate improvements to those services:
(n)[Repealed]
(o) to perform such functions as the Commissioner is for the time being directed to perform by the Minister in accordance with section 112 of the Crown Entities Act 2004:
(p) to exercise and perform such other functions, powers, and duties as are conferred or imposed on the Commissioner by or under this Act or any other enactment.
Thus, the information I have requested is consistent with the function of the HDC, which is "in relation to any matter affecting the rights of health consumers or disability services consumers or both, including statements and reports that promote an understanding of, and compliance with, the Code or the provisions of this Act".
Thank you for your assistance with my request. I trust that the information will be provided in a timely manner.

Amy S Van Wey Lovatt

Dear Amy
Official information request.
I am writing to acknowledge receipt of your official information request
to the Ministry of Health, dated 3 April 2020 for a copy of each referral
pathway for each region in New Zealand. Your request was transferred to
Wairarapa DHB on 1 May 2020.
It should be noted that many key staff involved with the sourcing and
preparation of material for your OIA request are also directly involved
with work associated with COVID-19.
This may impact on our ability to respond to certain OIA requests within
normal timeframes. If this is the case we will notify you as soon
practical.
We received your request on 1 May 2020. We will endeavour to respond to
your request as soon as possible and in any event no later than 29 May
2020, being 20 working days after the day your request was received. If we
are unable to respond to your request by then, we will notify you of an
extension of that timeframe.
If the information requested cannot be made available without substantial
collation, under section 18(f) and section 18A(1)(a) of the Official

soon as possible.
If any additional factors come to light that are relevant to your request,
please do not hesitate to contact us so that these can be taken into
account.
Please note that, like all DHBs across New Zealand, Wairarapa DHB has
adopted a model of proactive disclosure which sees OIA responses publicly
available on our website no less than one week after they have been
released.
If you believe there are any special reasons why proactive disclosure
should not apply to your response, we will be happy to consider this.

Dear Amy

the request or need to extend the timeframe for your response. In those
cases, we will advise why the extension is necessary, and indicate when
the response will be ready.

will be publicly available via our website around 10 days after they have
been released. Our response will advise if we intend to publish the

policy/ guidelines for Endocrinology services only, based on the
following:
According to the Health and Disability Commissioner (Code of Health and
Disability Services Consumers' Rights) Regulations 1996, Right 6 clause 3
(c),
"Every consumer has the right to honest and accurate answers to questions
relating to services, including questions about...(c) how to obtain an
opinion
from another provider;". Further, Right 7 clause 8 states: "Every consumer
has
the right to express a preference as to who will provide services and have
that preference met where practicable."
According to the MoH Operational Policy Framework 2019/20, available
through
Nationwide Service Framework Library <[3]https://nsfl.health.govt.nz>,
section 7.5.2 "Regions should ensure that clear referral pathways are in
place
and known to all clinicians."
Request 1:
I respectfully request a copy of each referral pathway for each region in
New
Zealand.
Background:
I am a New Zealand citizen. Waikato DHB, my DHB of Domicile (DoD), has
insisted that my GP provide a referral to services outside my DoD;
however,
when my GP referred me to the Southern DHB, the only DHB we could find
which
had a protocol consistent with the Endocrine Societies Guidelines for
testing
for hyper aldosteronism, the Southern DHB rejected the referral on the
grounds
that the referral was from my GP and not my specialist, Dr Wu, at my DoD.
Clearly, Waikato DHB and Southern DHB cannot both be correct, as they
contradict each other. [The statement, referrals must be from GPs AND
referrals cannot be from GPs, is logically false.]
I look forward to your response.

Dear Amy
Thank you for your request for official information, which was originally
received by the Ministry of Health (the Ministry) on 29 January 2020; an
aspect of your request related to the referral pathways for each region of
New Zealand.
On 8 March 2020, you challenged the response the Ministry sent you. The

is provided for in section 15A of the Act). We will advise you if such an

Information Act 1982 we may refuse the request or fix a charge under
section 15. If your request falls into this category we will inform you as
soon as possible.

Dear Amy
Re: Official Information Act request – A copy of each referral pathway –
Clarification sought – Necessary extension of time
We refer to your official information request received by Nelson
Marlborough DHB on 1 May 2020.
The Official Information Act requires that we advise you of our decision
on your request no later than 20 working days after the day we received
your request. Unfortunately, it will not be possible to meet that time
limit and we are therefore writing to notify you of an extension of the
time of an additional 10 working days to make our decision, to 15 June
2020.
This extension is necessary because, and as specified under Section
15A(1)(b) of the Official Information Act 1982, ‘consultations necessary
to make a decision on the request are such that a proper response cannot
reasonably be made within the original time limit’.
On 15 May 2020, the DHB offered you the opportunity to consider narrowing
the scope of your request to selected pathways. Please let us know of a
revised scope of your request before 5 June 2020.
You have the right to seek an investigation by the Ombudsman of this
decision. Information about how to make a complaint is available at
[1]www.ombudsman.parliament.nz or free phone 0800 802 602.

Re: Official Information Act request – A copy of each referral pathway –
Clarification sought
The Nelson Marlborough District Health Board (DHB) refers to your request
for Information under the Official Information Act 1982 (“the Act”), as a
partial transfer from the Ministry of Health, and received on 1 May 2020.
The DHB HealthPathways is an online health information portal with around
800 pathways for a general practice audience, to be used at the point of
care and is not set up for use by the general public. As such, the DHB
asks if you would consider narrowing the scope of your request to selected
pathways.
We will endeavour to respond to your request as soon as reasonably
practicable.
Thank you for your request.
