The information provided by Waikato DHB is inaccurate. I received a letter dated 14 August 2019 which stated:

"Waikato DHB can make the slides and blocks themselves available to the Third Party Provider directly once a request is received from them. This will enable the integrity of the slides to be preserved, and for them to be retested. The Third Party would then return the slides and blocks to Waikato DHB once their testing was complete.

The slides and blocks can be provided directly to you; however this would void the integrity of these and prohibit any further testing."

I have a recorded phone conversation with the histology manager, Mrs Worrall, from December 2019 who also confirmed there are two policies. One for Third Party Providers for review of the tissue and one for returning tissue to the patient.

Counsel for Waikato DHB submitted to the NZ High Court, there is such a policy for requests for tissue by Third Party Providers to obtain a second opinion.

I highly recommend making a complaint to the Ombudsman. Alternatively, altering the wording to request a description of their standard practice for handling requests for tissue by Third Party Providers to obtain a second opinion. I would ask if their standard practice is consistent with the Royal College of Pathologists Australasia (RCPA) policy, Provision of second opinions with particular reference to morphological examination. The RCPA is the professional body which sets the standards for NZ/AUS pathologists. Also, you could ask if such a policy is required for IANZ accreditation. I would be surprised if it were not.
