Micro chipping a question of who decides on the category.

Mary Phillips made this Official Information request to Nanaia Mahuta

The request was partially successful.

From: Mary Phillips

Dear Nanaia Mahuta,

When you introduced the requirement of dogs to be micro chipped who did you intend would decide which category the owners dog best fits i.e. Urban, Rural or working. Is it the owner or the Local Body?

Yours faithfully,

Mary Phillips

Dear Nanaia Mahuta,
Thank you for your reply.
Is there provision in the Dog Control Act for a category Rural. Section 40 sets out clearly the process required when registering a working or other exempt dog. Are councils legally permitted to create a category and alter the signed form when registering dogs.

Yours faithfully,

Mary Phillips

Kia ora Mary

The Minister of Local Government has passed your message on to the Department as we are responsible for the Dog Control Act 1996 (the Act). The Department cannot provide legal advice regarding the interpretation of the Act. We could however have a conversation with you to better understand the situation and point you in the right direction for assistance. If this is acceptable to you can you provide me with a phone number that you can be reached on?

Kind regards
Andrew
