Dear Human Rights Commission,

I request any information that supports Chief Human Rights Commissioner Paul Hunt's statement that “These are people who have lost loved ones, who have suffered severe side-effects of vaccination, and lost jobs” as shown in this media statement https://www.scoop.co.nz/stories/PO2202/S...

In addition, I request any documents relating to the meeting with “representatives from Voices for Freedom and the Human Rights Commission. Others represented included the Police, Freedom and Rights Coalition and independents” as described in said statement.

Finally, I request under section 23 of the Act a statement of reasons concerning Commissioner Hunt's aforementioned statement.

If any aspect of this request is unduly burdensome I am happy to refine this request.

The Human Rights Commission (“the Commission”) acknowledges receipt of
your requests for information, both dated 23 February 2022, which together
seek:

 1. Any information that supports Chief Commissioner Paul Hunt’s public
statement on 22 February 2022 that “these are people who have lost
loved ones, who have suffered severe side-effects of vaccination, and
lost jobs”;
 2. A statement of reasons pursuant to s23 of the Official Information Act
1982 concerning the Chief Commissioner’s above statement;
 3. Any documents relating to the Commission’s protest conciliation
meeting on 22 February 2022, including with representatives from
Voices for Freedom, Freedom and Rights Coalition, the Police and
independents; and
 4.  Any documentation (including but not limited to emails and text
messages) related to the amended wording of the part of Chief
Commissioner’s public statement on 23 February 2022.

 

Your request as currently framed will be very difficult to meet without
substantial collation or research. After an initial assessment, we have
reached the view that it would be difficult for us to respond to items 3
and 4 of your request within the 20 day time period required under the
Act. It will take us a significant amount of time to obtain, review,
consult with third parties, and make potential redactions to this
information and we are of the view that this would unduly interfere with
the Commission’s other operations.

 

Unless items 3 and 4 of your request are amended, we may have to refuse it
under section 18(f) of the Official Information Act 1982 (“OIA”), which
applies where the information cannot be made available without substantial
collation or research. Please let us know before Thursday, 24 March 2022
whether you are prepared to amend or clarify your request and, if so, how.

 

To address the Commission’s difficulty in meeting your request, we suggest
that the information could be released to you in an alternative format, by
providing a summary of the information we hold (pursuant to s16(2)of the
OIA).

 

We also note that, given the large quantity of information to be reviewed,
it will not be possible to meet the 20 working day timeframe to advise you
of our decision on your request. We therefore also notify you of an
extension of the time to respond to your request, to Wednesday 13 April
2022.

 

If you wish to discuss any aspect of your request with us, my colleague
Philippa would be happy to speak with you. Having a discussion about your
request may help us with providing the information you are seeking.

Extension of time limit to make a decision

On 23 February 2022, you requested various information and documentation
from the Human Rights Commission (“the Commission”) relating to the public
statement by the Chief’s Commissioner on 22 February 2023 and the
following amendment to the wording of this.

The Official Information Act requires that we advise you of our decision
on your request no later than 20 working days after the day we received
your request and we have previously advised an extension of this due date.
Unfortunately, it will not be possible to meet that time limit and we are
therefore writing to notify you of a further extension of the time to
provide the information to you, to 19 April 2022.

This extension is necessary because the external consultations necessary
to make a decision on your request are such that a proper response cannot
reasonably be made within the originally extended time limit.

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.

If you wish to discuss any aspect of your request with us, including this
decision, please feel free to contact me.

This second extension is not valid under the Act; extensions must be made within the initial 20 working days (in this case, 23 March).
Extending is likely not appropriate for this request; the information either exists or does not. As such, the extension is probably to allow for time to develop a media strategy/assess risks or due to a backlog.
If it's due to a backlog, the commission should hire more staff to process OIAs (OIA teams are notoriously understaffed and underpaid).
