Kia ora Kieran,
Thank you for the following question which was transferred to our agency
to respond to:
3. Contracts and emails with Valentia regarding Valentia hosting API
servers for ACC
We can confirm that ACC has an agreement with Valentia. However, we note
this agreement began in 2017, and therefore the email correspondence
between ACC and Valentia is significant. We further note that much of this
correspondence is administrative in nature.
In order for us to identify information that would be useful to you, we
would like you to clarify whether your request for emails can be
restricted to certain topics or matters. For example, the topics mentioned
in your 21 March email:
* Audits
* Security
* Funding descisions
* Future projects
Using more specific search parameters and having a manageable amount of
information will reduce the need to extend the timeframe for our response.
Could you please advise if your request for emails is limited to certain
topics and matters, and if so, what they are? Further, could you advise if
email correspondence that is primarily administrative in nature can be
deemed out of scope?
We’d be most grateful if you could please clarify this information by
Wednesday 26 April.

From: Kieren BP
Kia ora Sare,
Thank you for your email regarding my request for information related to Valentia Technologies NZ Limited. In response to your request for clarification, I would like to specify that my request for emails is related to the following topics:
- The systems that are currently managed, maintained, and/or created by Valentia
- Any audits that have been done related to Valentia's work for ACC
- Information related to security in relation to Valentia's work for ACC (with the understanding that some information related to security may need to be redacted in order to protect sensitive information and still fulfil this request)
- Funding decisions related to Valentia's work for ACC
- Future projects related to Valentia's work for ACC
- The costs associated with any of ACC's agreement with Valentia
- Any emails related to the introduction of Valentia and their staff to any staff at ACC, and how the parties met
- Stability and general issues related to Valentia's software and services provided to ACC
I note your comment that much of the email correspondence is administrative in nature, and I confirm that I am interested in administrative emails only to the extent that they relate to any of the above topics.
I hope this clarifies my request, and I look forward to receiving the requested information from your agency.
Thank you for your assistance in this matter!

Kia ora,
Thank you for your response. To help narrow the scope, I would like to clarify that my original questions were primarily related to the security and general use of Valentia's technology within Te Whatu Ora and other publicly funded services. Specifically, I am interested in obtaining any documents or communications related to:
1. Any audit findings, documents, and emails related to the stability and security of Valentia and Indici systems.
2. Contracts and emails with Valentia regarding the use of their systems within Te Whatu Ora, with a focus on the decision-making process behind the selection of Valentia's software over other available options.
3. Contracts and emails with Valentia regarding Valentia's software being used for helpline centers.
4. Any security decisions or concerns made to MOH/Te Whatu Ora regarding Valentia technology, including any self-reporting by Valentia or concerns raised by external/internal parties.
5. Any future projects or plans with Valentia, including any updates or changes to existing contracts.
6. All funding decisions and documents related to Valentia.
7. All discussions, contracts, and emails between Te Whatu Ora and Valentia (or external parties) related to the creation of Valentia's operations in New Zealand, including any documentation related to the decision-making process for establishing the partnership between Te Whatu Ora and Valentia.
8. A list and summary of all services provided by Valentia to MOH, DHBs, and publicly funded services.
I understand that this request may require substantial manual collation to locate and prepare all documents within scope, and I appreciate your efforts to assist me in narrowing the scope of the request where possible.
Thank you for your assistance in this matter. I look forward to your response.

I assure you that MOH does, in fact, hold copies of cyber security audits with Valentia. You should challenge their response and failing that send to Ombudsman.
