On 1/05/2023 you asked for information about what statutory authority was
exercised in ANPR requests.
Please see below response from our Business Technology group.
Please advise what statutory authority, including the section, (Privacy
Act, LGOIMA, Search and Surveillance Act etc...) was exercised in each
case.
Your request is declined under s17(e) of LGOIMA as the information does
not exist. NZ Police are not required to quote a statutory authority for
justification every time they request ANPR or CCTV data. AT’s [1]CCTV
Management at Auckland Transport webpage notes the overarching exemption
that covers this situation.
“Auckland Transport is only able to provide CCTV footage to the Police, or
any other third party, where that is allowed under the Privacy Act.For
example, Auckland Transport may provide CCTV footage to Police where the
footage is necessary to support their criminal investigations and not
providing it to them would prejudice the maintenance of the law.”
The relevant provision is exception (1)(e)(i) in IPP11 in section 22 of
the Privacy Act.
Should you believe that we have not dealt with your request appropriately,
you are able to make a complaint to the Office of the Ombudsman in
accordance with section 27(3) of the LGOIMA Act and seek an investigation
and review in regard to this matter.

You state that "NZ Police are not required to quote a statutory authority for justification every time they request ANPR ... data. ... Auckland Transport is only able to provide CCTV footage to the Police, ... where that is allowed under the Privacy Act."
You then state that the exception (1)(e)(i) in IPP11 in section 22 of the Privacy Act 2020 provides a wide ranging exception to the privacy act disclosure rules.
IPP 11 was explored by the New Zealand Supreme Court in R v Alsford [2017] NZSC 42. (https://www.courtsofnz.govt.nz/assets/ca...) At [33] of that case, the Court expressed that the "requesting agency [the Police] must provide the holding agency with sufficient information to enable it to reach a reasonably-based view about whether or not the information is required for an authorised purpose. ... it would not be sufficient for the police simply to request information without giving any indication of why it was sought... , the mere fact that police request information will not meet the threshold."
