On 22 April 2024, you requested the following information, under the Local
Government Official Information and Meetings Act 1987 (LGOIMA):

 

How does Council manage conflicts of interests for Staff who are also, or
aspire to be, Elected members?

 

I was not able to immediately find any policy online other than the Code
of Conduct; however, that only applies to people in their role as an
Elected member (not as Staff).

 

Prior to each triennial election, election protocols are issued to Council
staff, the protocols issued in May 2022 are still available on the
internal intranet for any staff member who may be thinking of running for
a future election (Attached). The general rule is that these are
applicable at any time for any election for ‘public office’ and reminders
are issued to staff ahead of the general election where these protocols
are referred to.

 

The protocols refer specifically to the Local Government Act (2002). The
act states that if an employee of a local authority (such as Christchurch
City Council) is elected to be a member of the local authority’s governing
body, that staff member must resign from their position before taking up
the role as an elected member (in accordance with s41(5): [1]Local
Government Act 2002 No 84 (as at 17 February 2024), Public Act 41
Governing bodies – New Zealand Legislation). This does not apply if the
officer is elected to a community board or another local authority.

 

There are equivalent protocols issued to elected members ahead of
elections. During a by-election, these protocols are referred to in
communications to staff and elected members. For staff looking to be
appointed to a Community Board role, a similar process occurs.

 

It is also worth noting that at all points of their employment, Staff are
bound to the Council Code of Conduct which makes specific reference to
political neutrality:

Dear Official Information,

Thank you for supplying that document.

LGA s41(5) states that "An employee of a local authority who is elected to be a member of the local authority’s governing body must resign from his or her position as an employee of the local authority before taking up his or her position as a member of the local authority."

Governing body is defined in the LGA as "in the case of a territorial authority, means the body described in section 41(2)".

LGA s41(2) states "A territorial authority must have a governing body consisting of members and a mayor elected in accordance with the Local Electoral Act 2001."

Member is defined in the LGA as "in relation to a community board, means a member appointed to that board or elected to that board under the Local Electoral Act 2001:"

It would appear that community board members are in fact members, and so part of the governing body, for the purposes of the LGA, per s41(2), and so must resign, per s41(5)

Please advise how Council came to offer the advice that "If elected to Council, an officer must resign their position (in accordance with s41(5) of the Local Government Act 2002). This does not apply if the officer is elected to a community board [..]".

The "governing body" is defined as "consisting of members and a mayor
elected in accordance with the Local Electoral Act 2001" (section41(2) of
the LGA).  If community board members were members of the governing body
the expectation is that the definition of a member of a community board
would make reference to the community board being the governing body.
"Member" is defined in section 5 of the LGA as follows:

 

member,—

(a)          in relation to a community board, means a member appointed to
that board or elected to that board under the Local Electoral Act 2001:

(b)          in relation to the Commission, means a member of the Local
Government Commission:

(c)           in relation to a local authority, means a member of the
governing body of the local authority elected under the Local Electoral
Act 2001:

(ca)        in relation to a local board, means a member appointed to that
board or elected to that board under the Local Electoral Act 2001,
including the chairperson:

(d)          in relation to a regional council, means a member of the
governing body of the regional council elected under the Local Electoral
Act 2001, including the chairperson:

(e)          in relation to a territorial authority, means a member of the
governing body of the territorial authority elected under the Local
Electoral Act 2001, including the mayor

 

The definition of a member of a community board makes no reference to
community board being a governing body, whereas, the definition of a
member of a territorial authority does reference being a member of a
governing body. The definition of "governing body", as referenced above,
refers to "members and a mayor" which is consistent with the definition of
a member of a governing body but not the definition of a member of a body
which references members including a chairperson.

 

The Council is the governing body and, therefore, section 41(5) of the LGA
does not apply if a member of staff is elected a community board as it is
not the governing body.

 

In summary the Council is the governing body and the community board is an
entity that is subordinate to the Council.
