Worksafe's working relationship with the Ministry of Health
Erika Whittome made this Official Information request to WorkSafe New Zealand
The request was successful.
From: Erika Whittome
Dear WorkSafe New Zealand,
I see the Ministry of Health have published advice about workplace diseases on their website dated 16 March 2024 here
https://www.health.govt.nz/our-work/dise...
The MoH says:
"What is required under the Health and Safety at Work Act
Any infectious disease encountered in the workplace is considered a workplace hazard."
Would you kindly share the information on
- the working relationship between Worksafe and the MoH in the year 2024 ?
- any memorandums of understanding between the two agencies.
- how there has been designation of powers to the MoH to authorize the MoH to regulate workplaces?
- how Worksafe is working together with the MoH on the list of recognized workplace diseases that arise out of the nature of the work taking place in 2024? I note the date of this MoH publication is 16 Mar 2024.
Yours faithfully,
Erika Whittome

Dear Ministerial Services – WorkSafe,
Thank you for your response. I see question 3, the response is
3. WorkSafe is the primary work health and safety regulator. No powers under the Health and Safety at Work Act 2015 (HSWA) have been designated to the Ministry of Health.
Has Worksafe ever prosecuted another agency for impersonating health and safety functions, roles and/or powers under HSWA? I see s180 and 182 of HSWA mention $10,000 fines for impersonations.
Yours sincerely,
Erika Whittome

Dear Ministerial Services – WorkSafe,
I checked this MoH page https://www.health.govt.nz/our-work/dise...
And it's now no longer published. Did you supply and communicate with the MoH with information about that page which they have now removed? If so, would you please share the communications?
Yours sincerely,
Erika Whittome
