Dear Shane Reti (MIN),
I asked for the sections previously deemed “out of scope” in documents 2 and 3 to be provided. Lots of issues with your response:
1. You gave me document 1 again which was not requested.
2. You supplied document 2 again without supplying the “out of scope” sections and also not providing the attachments.
3. You provided document 3 unredacting 5 sentences below, which appear to be clearly within the scope of my previous request.
4. Then you redacted some information that was previously supplied, also in scope.
5. You state that the remaining information remains out of scope from my current request without providing justification for the claim.

Allow me remind you again of my request which was “please provide these email documents with the “out of scope” sections displayed and including the attachments”. Therefore I can conclude the following:
A. that you have not provided a reason to refuse my current request on the basis that it is out of scope, as my direct request has made it in scope.
B. that you did not properly comply with my earlier request deeming some in scope sections as "out of scope"

Hence, please provide the remainder of this information requested or a valid reason for refusal by the due date of Sept 18.

Dear Shane Reti (MIN),
As already stated I have made the request in scope by being very specific about what I am asking for and hence have 100% made the request with “due particularity” as per OIA 1982 Part 2 Section 12(2), therefore you are not able to legitimately refuse it on that basis.
There is already a complaint that has been made with the ombudsman about this, case number already allocated, you will be hearing from them in due course.
