You have requested copies of any correspondence sent to the Ombudsman by the Capital and Coast District Health Board in relation to your complaints (reference numbers 537829 and 498602).

The Ombudsman is not subject to the Official Information Act 1982 (OIA) or the Privacy Act 2020, but is committed to applying the spirit of the legislation wherever possible and practical, and subject to the statutory secrecy and confidentiality obligations that apply to the Ombudsman.

Section 21 of the Ombudsmen Act 1972 (OA) requires that an Ombudsman and their staff maintain secrecy of all matters that come to their knowledge. The Ombudsman must also conduct their investigations in private (section 18(2) of the OA).

Due to these statutory obligations, the Ombudsman is not able to provide you copies of another person’s or agency’s correspondence with his office. This includes correspondence provided by the Capital and Coast DHB in relation to your previous complaints to the Ombudsman.

I note that where the Ombudsman has investigated or decided to take other action on your complaints, he has provided reasons for that decision or informed you of the outcome of the investigation as appropriate – including references to what information he relied on to inform that opinion or decision (see sections 17(2) and 24 of the OA and section 33 of the OIA).
