Official Information Act (Act) Request
Thank you for your email request received 24 January 2023.
You requested the following information related to the day of 2nd January
2023 visible from the Buller Gorge South Island:
1. Airline (s) flying over / visible from the Buller Gorge 2nd
January 2023 between 11am - 2pm (might have started earlier and finished
later but visible during these times)
2. Company responsible
3. Purpose
4. Consents required if any for atmospheric spraying - do
Airways authorize these or another agency?
5. Agency responsible - NIWA
6. Ultimately I want to know the process from start to finish
and who is responsible for atmospheric spraying under whose instruction.
Release of Information granted
1. In relation to your first request: The attached shows 11 aircraft
tracks flying overhead the Buller Gorge area during the times given.
2. In relation to your second and third requests: All the aircraft
depicted are either Air New Zealand or Jetstar commercial flights,
Auckland-Queenstown-Auckland. Note, the above aircraft would be flying at
over 30,000’ (FL300) and so could be displaying condensation trails.
Refusal of Request
3. In relation to your fourth, fifth and sixth requests: These requests
are not applicable to the subject aircraft movements (see our response
immediately above). If you intend for your request to be treated more
generically, beyond application to the subject aircraft, then I can advise
that Airways Corporation: (a) do not authorise such consents; and (b) do
not hold information regarding the process for atmospheric spraying nor
information regarding the relevant authorising agency. I do not have
grounds to believe NIWA holds this information or that the information is
more closely connected with another agency. For this reason, the relevant
requests are refused pursuant to section 18(g) of the Act.
Your rights
You are entitled to apply to the Ombudsman for a review of this decision
pursuant to section 28(3) of the Act.
