22/438290, specifically cause # 1.11.
TRIM 22/438290 is a document titled Volume C – Christchurch Water Supply
Water Sources, which does not appear to have a clause 1.11.
We note that Volume B however does have a clause 1.11 which relates to
emerging contaminants in drinking water supply wells.

I refer to your LGOIMA request made on 4 September 2024. Feel free to
ignore my previous email from this morning as I note that we have already
provided you with both documents (along with volume A) on 25 September
2023.
I’ve reattached all three documents for you in case you’ve misplaced them.
Please note that all three documents were last revised on 27 May 2022 and
prepared in accordance with the Water Services Act 2021, the Health Act
1956, the Drinking Water Standards for NZ 2005 (revised 2018) and other
legislative requirements that were in effect at that time. As such, this
plan (or aspects of it) may no longer be accurate or reflect current
information or legislative requirements.
There is a small amount of information withheld in this version under the
following sections of the LGOIMA:
- 7(2)(a) – to protect the privacy of natural persons
- 7(2)(d) – to avoid prejudice to measures protecting the
health or safety of members of the public
- 6(d) - to endanger the safety of any person.
In the Council's view the reasons for withholding these details are not
outweighed by public interest considerations in section 7(1) favouring
their release.
You have the right to ask the Ombudsman to investigate and review our
decision. Complaints can be sent by email to

As stated in our correspondence with you between the time you submitted
this request and when we provided the documentation, TRIM22/438290 or
Water Safety Plan Volume B, does not contain a clause #1.11.
In providing the final decision for this LGOIMA request on 30 September
2024, we provided both the requested document (TRIM22/438290) as well as
the other two volumes, including Volume C which appeared to be the
document with the correct clause that you were looking for (#1.11).
At this point, your original request for information from 4 September 2024
was fullfilled.
On Wednesday 16 October 2024 you then asked a new question:
The information in Volume C, Source Risk Assessment Table, Clause No. 1.11
is redacted in part. Which part of the Act is this redacted under and why?
Specifically, these are redactions relate to:
1. "PFOS/PFOA found in shallow groundwater at [redacted]"
2. "There are no water supply wells near Wigram and the airport.
[redacted] Testing in distribution system showed no presence of
PFOS/PFOA."
It is worth noting that in our response on the 30 September 2024, and when
these documents had first been provided to you previously on 25 September
2023, you were told that the redacted information was being withheld under
the following sections of the LGOIMA:
o 7(2)(a) – to protect the privacy of natural persons
o 7(2)(d) – to avoid prejudice to measures protecting the health or
safety of members of the public
o 6(d) - to endanger the safety of any person.
As there have been no further variations or revisions made to these
documents since 27 May 2022, the documents provided are the same documents
that you were provided in 2023, released again after confirmation that the
redactions were still appropriate.
We noted that these redactions were done before our recent process
improvement where we now cite the clause directly on the redaction for
further clarity, and as such, we chose to accept the new LGOIMA request in
good faith that you were seeking further clarification on which of the
three provided clauses the specifically referenced lines from Volume C are
being withheld under.
A request for further information on specific lines in a separate document
is not the same as a request for the supply of a document that was
requested and provided previously (LGOIMA 1195217) in September.
Therefore, this request (LGOIMA 1222589) is being treated as a new request
under the LGOIMA.

On 16 October 2024, you requested the following information, under the

We can confirm that this was previously being withheld under section
7(2)(d) of the LGOIMA as listed in the reasons provided to you along with
the information.
The redaction refers to a privately owned industrial site that the testing
came from which was provided via ECan (not CCC sampling data). Upon
further investigation into this site, it appears that it is owned by a
company (Valmont Coatings (NZ) Limited) and the information about the site
and risks are now publicaly available.
As such, we have decided to provide you with the information which was
redacted. These two redactions are as follows:
1. “27 Washbournes Rd (information provided by ECAN)”
2. “27 Washbournes Rd located hydraulically down-gradient from Sockburn
pump station.”
You have the right to ask the Ombudsman to investigate and review our
